About this file

This Justification Review Document is for a sole-source contract for ScrubeEx Maintenance and Support services at William Beaumont Army Medical Center (WBAMC) in Fort Bliss, Texas. The United States Army Corps of Engineers, Huntsville Center (CEHNC) seeks to award a five-year contract to L1 Enterprises Inc., the exclusive distributor and service provider for IPA's proprietary ScrubeEx equipment. The contract will consist of a base year from 30 September 2025 to 29 September 2026, with four optional 12-month extension years through 29 September 2030.

The ScrubeEx system is a secure, advanced machine that provides authorized staff with clean medical scrub uniforms, manages inventory, and generates real-time insight into linen usage. The equipment is already installed throughout WBAMC and cannot be serviced by other vendors. Market research conducted on NASA SEWP and GSA platforms yielded no alternative sources. The contract is critical to hospital operations, as service disruptions could delay staff responses and potentially compromise patient care by impacting uniform availability. The total contract value is redacted, and the procurement is being conducted as a sole-source action under FAR 6.302-1, with no competitive alternatives identified.

4. Authority Cited: FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: In accordance with FAR 6.302-1, it has been deemed that only one responsible source and no other supplies or services will satisfy agency requirements.

ScrubEx is the Original Equipment by IPA Manufacturer, and L1 Enterprises, Inc., is the only authorized distributer and service provider for the IPA ScrubEx Equipment.

a. Background: Market Research for the previous contract was conducted by posting a Request for Information on NASA SEWP from 12 July 2023 – 19 July 2023 and on GSA from 24 – July 2023 – 28 July 2023. As a result of both RFI postings, no responses were received. The IPA ScrubEx is a proprietary hardware and software equipment system that is not available from other commercial retailers. L1 Enterprises Inc. is the exclusive partner, distributer and service provider authorized vendor licensed to sell and work on IPA ScrubEx equipment which is already installed throughout WBAMC. An authorized reseller letter was provided by IPA dated 25 July 2025 supporting that it remains the sole service provider to fulfill this requirement.

b. Justification: L1 Enterprises Inc. is the exclusive partner, distributer and service provider authorized vendor licensed to sell and work on IPA ScrubEx Equipment. The IPA ScrubEx Equipment cannot be purchased, distributed, or services by any other company.

c. Alternatives: No alternatives can be sought unless WBAMC were to completely replace its currently installed ScrubEx equipment which is not feasible as it is not yet at the end of its useful life.

d. Impact if not approved: delay of service and lapse of maintenance of the equipment at the hospital can cause delays in employees receiving clean scrubs. Service disruptions may impact patients directly by delayed responses from the staff due to nonavailability of clean scrubs and by potentially jeopardizing the welfare of patients often already weakened and more susceptible to infection, or other medical complications.

6. Efforts to Obtain Competition: Because this is a sole source action, effective competition is not possible. The Contracting Officer published the notices required by FAR 5.201 and any bids or proposals received were considered. The Government will comply with the posting requirements of FAR 6.305 – availability of the justification within 14 days of award. Further, subcontracting opportunities do not exist for this requirement.

7. Actions to Increase Competition: It is anticipated that since the ScrubEx Equipment, hardware firmware and software updates are proprietary to IPA Inc., and L1 Enterprises Inc., is the exclusive authorized partner for the equipment procurement, distribution, and service provider, opportunities to increase competition may not exist unless WBAMC is ready to completely change the brand and type of ScrubEx Equipment. For other future ScrubEx Equipment requirements that integration is not required, they will be competed among all eligible contractors to the extent possible.

8. Market Research: The IPA ScrubEx is proprietary hardware and software equipment system is not available from other commercial retailers. IPA provided confirmation letter on 25 July 2025 that L1 Enterprises Inc. is the exclusive partner, distributer, and service provider authorized vendor

licensed to sell and work on IPA’s ScrubEx Equipment which is already installed throughout

WBAMC.

For this procurement, based on the rationale slated above, it is determined to be in the best interest of the Government to award to L1 Enterprises Inc. as the sole source for the IPA ScrubEx Manufacturer equipment. L1 Enterprises is the exclusive partner and sole source distributer for the IPA ScrubEx Equipment, and related services.

9. Interested Sources: The Government has determined no other source can deliver a product to meet the Government’s requirements. To date, no written responses of interest have been received.

10. Other Facts:

a. Procurement history. The original contract was awarded to L1 Enterprises Inc, SDVOB, W912DY20F0448, on 16 July 2020, with 4 option years. It was solicited as full and open competition; however, no offers were received, and L1 Enterprises Inc. was deemed the exclusive partner. The equipment was procured and installed on the base year of this contract with Maintenance and Services provided in the option years. Only 2 option years were awarded because of failure to receive funding needed to exercise the remaining option years. A subsequent contract was awarded 08 August 2023, W912DY23P0018, with a base year plus three option years. The option years were never exercised because the customer didn’t receive funds to exercise the first option year. Both actions were sole source contracts IAW FAR 13.106-1(b), Single Source Justification under the Simplified Acquisition Threshold.
