SBU - CONTRACTING AND ACQUISITIONS

LIMITED-SOURCES JUSTIFICATION

FOR LIMITING SOURCES ON THE MULTIPLE-AWARD SCHEDULE PROGRAM

FAR Part 8.4

1. Identification of the agency and the contracting activity:

The Office of Acquisition Management proposes to enter into a Blanket Purchase

Agreement (BPA) on the basis of other than full and open competition for Role Players and Vehicles for the Counterthreat and Countersurveillance Teams requirement on behalf of the Department of State (DOS), Bureau of Diplomatic Security (DS), Threat

Investigations and Analysis Directorate (TIA), Office of Protective Intelligence

Investigations (PII).

DS/TIA/PII is the lead DS investigative office for threat investigations against all personnel under Secretary of State security responsibility overseas, as well as DOS personnel, facilities, and foreign diplomatic facilities and personnel in the U.S.

DS/TIA/PII manages and oversees the DS Threat Management Unit and Threat

Management Training Programs.

2. Nature and/or description of the action being approved.

This sole source action will provide a new single award BPA to RMGS, Inc. for Role

Players and Vehicles for the Counterthreat and Countersurveillance Teams. The BPA will have a period of a base year plus four (4) option years and allow for firm-fixed price and hybrid firm-fixed price (FFP) / time and materials (T&M) orders.

3. A description of the supplies or services required to meet the Department’s needs.

This requirement is to provide role players and vehicles for the Counterthreat and

Countersurveillance Teams. The role players and vehicles are to augment Instructor Led

Threat Detection training courses to help ensure students face a professional level adversary and have the ability to recognize bad actors and threats, utilizing principles learned from the course. The vehicles will not be leased or purchased by the

Government; they are to be utilized by the contracted role players in various scenarios.

This will allow DS/TIA/PII to successfully manage and conduct threat management training for DS personnel, interagency partners, and international partners both domestic and abroad, and conduct counter surveillance operations in support of DS protective operations both domestic and abroad.

The total estimated value is for a base year plus four (4) option years.

4. The authority and supporting rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the supply or services. This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41

U.S.C. 152(3), and 40 U.S.C. 501), as implemented by FAR 8.4 and substantiated by the following:

☒ FAR 8.405-6(a)(1)(i)(B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

A sources sought was posted to GSA eBuy, which produced responses from five (5) small businesses and two (2) large businesses. An evaluation of the responses found only one vendor, RMGS, has the unique, necessary experience to meet the Government’s requirement IAW the SOW, including a plan for the inclusion of vehicles into the scenario role play, which is a unique aspect of the Government’s requirement and not addressed by the other respondents.

RMGS’ experience includes providing role players for surveillance operations. RMGS also maintains a large database of role players for ongoing work since it regularly provides role players for similar work to other agencies. The experience of all other respondents included role players for tactical, bomb/IED detection, and ship hijacking, but not surveillance.

The requirement includes the vendor to provide vehicles for the role players to utilize as part of the surveillance scenarios. The sources sought notice requested respondents to provide a summary of how their capabilities would support the services described by the

SOW. Only RMGS provided information incorporating the vehicles into their capabilities summary, no other respondent provided the requested vehicle information.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d) and FAR 8.405-2(d).

GSA has already determined schedule prices to be fair and reasonable IAW FAR

8.404(d). The Contracting Officer will consider the level of effort and mix of labor proposed to perform a specific task being ordered at the individual order level and determine the total price is reasonable IAW FAR 8.405-2(d). By signing the justification, the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable.

6. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

A sources sought was posted to GSA eBuy on 8 September 2021 and closed on 17

September 2021. The notice provided the Statement of Work (SOW) and requested a summary of the company’s technical capabilities which would support the required services and past performance examples.

The notice produced responses from five (5) small businesses and two (2) large businesses.

An evaluation of the sources sought responses found only one vendor, RMGS, that has the unique, necessary experience to meet the Government’s requirement IAW the SOW, including a plan for the inclusion of vehicles into the scenario role play, which is a unique aspect of the Government’s requirement and not addressed by the other respondents.

7. Any other facts supporting the use of this justification.

DS/TIA/PII specifically requires surveillance-experienced role players and the ability to incorporate vendor supplied vehicles into the scenario role play to provide the most realistic training experience possible. RMGS is the only vendor capable of providing the necessary experience required plus a vehicle solution that DS/TIA/PII needs to accomplish its mission.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The market will be continuously surveyed for vendors capable of providing a solution that will meet mission requirements.
