About this file
This is a Justification for an Exception to Fair Opportunity (J&A) document for a federal task order acquisition by the Department of Veterans Affairs.
The VA's Technology Acquisition Center seeks to issue a Firm-Fixed Price task order under the NASA Solutions for Enterprise-Wide Procurement (SEWP) Contract NNG15SC67B with Cynergy Professional Systems to provide Motorola communications equipment to VA Southern Nevada Healthcare System in North Las Vegas, Nevada. The deliverables include Motorola APX N30 Radios, CommandCentral AXS Dispatch Consoles, radio programming, console installation, all necessary equipment and labor, and one year of maintenance support. Two one-hour training sessions on AXS console operation will be conducted upon completion. The acquisition is justified under 38 U.S.C. 8127(c), the Veterans First Contracting Program, which permits direct contracting with Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). Cynergy Professional Systems, located in Laguna Hills, California, is a certified SDVOSB and authorized Motorola OEM reseller. Market research conducted in January 2026 evaluated competitors including Harris, Kenwood Viking, L3Harris, and EF Johnson but determined that only Motorola CommandCentral AXS provides full interoperability with the region's existing Motorola ASTRO 25 infrastructure and mission-critical functionality required for emergency communications. The justification emphasizes that alternative platforms would result in unacceptable risks including dropped communications, roaming failures, and loss of encrypted communications access. Cynergy's authorization ensures access to OEM-protected software, system keys, and firmware unavailable through unauthorized vendors. The acquisition is below the $5,000,000 threshold, pricing is based on NASA SEWP GWAC catalog pricing determined fair and reasonable, and Cynergy maintains Excellent performance ratings on the SEWP program. The Advocate for Competition approved the acquisition on August 11, 2026, with public availability of the justification required within 14 days of award.

Motorola Hardware and Maintenance VA-26-00048856
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724
2. Description of Action: The proposed action is for a Firm-Fixed Price (FFP) Task Order (TO) that will be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) Contract Number NNG15SC67B with Cynergy Professional Systems to provide Veterans Affairs Medical Center (VAMC) Las Vegas with Motorola APX N30 Radios, AXS Dispatch Consoles, Radio Programming and the installation of the consoles.
3. Description of the Supplies or Services: The proposed action is to provide APX N30 Radios, AXS Dispatch Consoles, Radio Programming and the installation of the consoles at the VA Southern Nevada Healthcare System, 6900 N. Pecos Road, North Las Vegas, NV 89086. The Contractor shall also provide all additional equipment, labor, supervision, and materials required to complete the project along with one year of maintenance support. Once installation and configuration are complete, two one-hour training sessions will be conducted on the AXS operation. The total estimated value of the proposed action is
4. Statutory Authority: The statutory authority permitting an exception to fair opportunity for this action is 38 U.S.C. 8127(c), known as the Veterans First Contracting Program which provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). This authority is pursuant to the exception to the fair opportunity process at Revolutionary FAR Overhaul VA Deviation 16.507-6(b)(5), which states that “For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.”
5. Rationale Supporting Use of Authority Cited Above: The proposed source is Cynergy Professional Systems, 23187 La Cadena Drive, Laguna Hills, CA 92653. Cynergy Professional Systems is a Service-Disabled Veteran-Owned Small Business (SDVOSB) that is fully authorized and certified to provide Motorola Solutions’ public safety communications equipment, software, and integration services. As an original equipment manufacturer (OEM)-authorized reseller with extensive experience supporting mission-critical Land Mobile Radio and dispatch environments, Cynergy Professional Systems is uniquely positioned to meet the agency’s requirements effectively, efficiently, and economically, while ensuring compliance with federal procurement preferences for SDVOSBs. The requirement includes procurement and integration of Motorola’s CommandCentral AXS Dispatch Console, which is specifically engineered to operate within Motorola’s public safety communications ecosystem. The CommandCentral AXS platform provides capabilities and system-level functionality that are critical to emergency communications operations and not available through non-OEM solutions or generic dispatch platforms.
The CommandCentral AXS Dispatch Console is the only dispatch platform that provides full and direct access to the agency’s Motorola mission-critical communications environment without function loss or the need for unsupported integrations. Dispatchers require immediate and uninterrupted access to alarms, talkgroup changes, emergency notifications, and encrypted communications to coordinate timely responses. The AXS console’s native interoperability ensures these functions are maintained without additional middleware, increased latency, or loss of features, all of which would impose unacceptable risks in emergency operations. Interoperability and System Compatibility Research confirmed that regional public safety communications infrastructure is predominantly Motorola, including dispatch console configurations, encryption key management, ISSI/CSSI gateways, and subscriber programming templates. Motorola CommandCentral AXS is the only dispatch console platform that integrates natively with the region’s Motorola system core and provides full access to system-level controls and talkgroup management. Interoperability with surrounding agencies—critical for joint responses, mutual aid, and daily operational coordination—can only be fully achieved through Motorola subscriber units and consoles. Performance and Reliability Data Field operational feedback, system logs, and after-action reviews demonstrated that Non- Motorola units experienced higher rates of dropped communications, loss of system affiliation, and roaming instability when operating on the region’s Motorola-based ASTRO 25 network. Motorola radios consistently demonstrated superior audio quality, stable roaming, and uninterrupted connectivity, essential for officer and responder safety.
Cynergy Professional Systems, as an authorized SDVOSB reseller and integrator of Motorola technology, is uniquely qualified to deliver, configure, and support this equipment. Their authorization ensures access to OEM-protected software, system keys, interface protocols, firmware, and security updates that are not accessible through non-authorized vendors. This protects system integrity, ensures proper lifecycle support, and maintains warranty and cybersecurity compliance. For these reasons, the combination of Motorola’s proprietary CommandCentral AXS platform and its authorized, SDVOSB-certified role, Cynergy Professional Systems is uniquely capable of meeting the agency’s operational, technical, and mission-critical requirements without degradation of service or unacceptable risk to public safety operations and is in the best interest of the Government.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that could meet the Government’s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 16.507-6(f)(1), the justification will be made publicly available on the Contracting Opportunities Page within 14 days of award.
7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be completed.
8. Market Research: Market research efforts were conducted during January 2026 to determine if competition was viable for this action. Specifically, the Government technical experts reviewed multiple manufacturers including Harris, Kenwood Viking, L3Harris, EF Johnson, and Motorola Solutions. While several vendors produce P25-compliant radios, market research determined that Motorola is the dominant and primary vendor in the region, with surrounding agencies—including law enforcement, fire departments, emergency medical personnel, and regional interoperability groups— operating on Motorola ASTRO 25 infrastructure and Motorola subscriber units. Only Motorola subscriber units and dispatch solutions provide full feature compatibility with local partner systems without the loss of mission-critical functionality. Harris subscriber radios, although P25 compliant, have experienced consistent operational issues, including dropped transmissions, roaming failures, and intermittent connectivity on Motorola-based systems—issues acknowledged by both field operations and technical staff. Based on these findings, alternative vendors were unable to provide the level of interoperability, reliability, and system-native integration required for mission-critical communications. Cynergy Professional Systems, an authorized Motorola reseller and integrator with access to OEM-protected software, system keys, firmware, and configuration tools, is the most effective, efficient, and economical solution for this procurement.
The Small Business Administration certification database was accessed in August 2026.
This search concluded that Cynergy Professional Systems is registered, certified and qualifies as a SDVOSB in accordance with the federal small business size standard for the applicable North American Industry Classification System Code 541519. It was also verified that Cynergy Professional Systems is registered in SAM.gov database and is eligible to receive government contracts. The Contracting Officer reviewed NASA SEWP V Program Performance Ratings and all ratings were Excellent, demonstrating they are a responsible contractor with respect to performance.
9. Other Facts: The Procuring Contracting Officer has determined that this proposed action meets all the requirements of 38 U.S.C. 8127(c) and VAAR 819.7008. This acquisition is below the $5,000,000.00 threshold, Cynergy Professional Systems is a responsible SDVOSB for performance of the services described herein, the proposed contract can be awarded at a fair and reasonable price and is in the best interest of the Government.
