Justification for Other than Full and Open Competition Justification

Contracting Activity: 106 MSG/MSC, 150 Riverhead Road, FS Gabreski ANG, Westhampton Beach NY 11978.

Description of Action: This contract action is in support of the logistics support services currently performing at the 103rd Rescue Squadron at FS Gabreski ANG, New York.

This contract action is to provide for the continuation of support service requirements for the 103rd Rescue Squadron for the period of 25 June 2018 to 24 July 2018. This additional period of performance is required to allow the orderly award and transition of the follow-on award.

This approval is being requested for a single source acquisition because there is only one known contractor who possess the specialized experience and personnel that is currently performing this work. Because of the time involved in phasing-in services from another contractor and the short term nature of the continuous services, this current contractor is considered to be the only source capable of meeting the 103rd Rescue Squadron’s needs without a disruption in service.

A firm fixed price contract will be negotiated with Darkblade Systems Corp from Stafford, VA.

The total government estimated cost for the services is $40,000.00. The funds used to procure this project are O&M funds.

Description of Supplies/Services:

Maintenance of the 103rd Rescue Squadron mission equipment.

Authority Cited:

The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(d) (1)(B) as implemented by FAR 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.

Reason for Authority Cited:

Due to the criticality of this current requirement, the services must be completed by the current contractor as stoppage of services would greatly degrade the rescue equipment that supports the mission of the 103rd Rescue Squadron. Lack of on-site compliance support would cause a non-compliance and jeopardize the current mission. The Government has determined the incumbent is the only source able to provide support given the inherent complexity of these services.

Efforts to Obtain Competition:

Market research has been conducted in which there are five known sources that can accomplish this work. The issue of mobilizing a new company at this time will jeopardize current mission.

Actions to Increase Competition: N/A

Fair and Reasonable Cost:

Per FAR 15.404-1(b) – Proposal Analysis Techniques, it is anticipated that the cost to the Government will be fair and reasonable based on comparison with previous DoD orders for the same equipment that has historical pricing.

Fair and Reasonable Cost Determination:

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Price reasonableness may be determined by cost analysis of the contractor’s quote, previous DoD contracts, use of parametric estimating method (Means book) and historical pricing.

Based on the foregoing justification, I hereby approve the procurement of the logistics support services for the 103rd Rescue Squadron on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(d) (1)(B) and FAR 6.302-1(a)(2)(iii)(B) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”, subject to availability of funds, and provided that the services and property herein described above have otherwise been authorized for acquisition.
