This document is a Justification and Approval (J&A) for a sole source acquisition to Deque Systems, Inc. for the Axe Monitor Tool, which is required by the Defense Logistics Agency (DLA) for Section 508 compliance scanning support. The J&A confirms that Deque Systems, Inc. is the only vendor that can meet the four major DLA requirements, which include DoD/DLA PKI/PKE, DoD/DLA Cybersecurity, VPAT/Accessible, and Remote Scanning and Metric Retention Capability. Deque Systems, Inc. is the only vendor that currently meets the DoD Cyber Security and FedRAMP standards described in NIST Special Publication 800-171. The Axe Monitor Tool consists of two components that will be used and hosted within DLA, and only Deque Systems, Inc. can ensure the components are fully functional within the required DLA environments. The J&A states that the Government will continue to assess the procurement environment to determine compatibility with DLA requirements and promote competition to the maximum extent practicable.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF CITED
AUTHORITY.
The market research confirms that Deque Systems, Inc. is the only vendor with the Axe Monitor Tool which can handle the four major requirements identified above and the necessary experience in supporting the government’s unique requirements. Deque Systems, Inc. has the capability of handling all four major DoD/DLA requirements which consist of DoD/DLA PKI/PKE, DoD/DLA Cybersecurity, VPAT/Accessible, and Remote Scanning and Metric Retention Capability to successfully perform the Section 508 Compliance Scanning Support Procuring the Axe Monitor Tool for this reason is essential to sustainment and further development to support the continuously changing Section 508 Compliance standards environment. Furthermore, Deque Systems is the only vender that currently meets the DoD Cyber Security and FedRAMP standards (listed below). These standards are described in NIST Special Publication 800-171 which is a DoD requirement.
In each of these areas, there are specific security requirements that DoD contractors must implement.

DLA Section 508 Compliance PMO uses Axe Monitor Tool as its sole annual maintenance support, updates, patches, upgrades and licenses. Axe Monitor Tool consists of two components that will be used and hosted within DLA which includes Axe Monitor and Axe Devtools Browser Extension. Axe Monitor will be used as an accessibility monitoring, audit and reporting tool providing the capability of scanning DLA Applications from an automated perspective, scanning layers deep utilizing dynamic crawling within web applications capturing detailed accessibility issues. Only Deque Systems, Inc. can ensure components and capabilities of Axe Monitor and Axe Devtools Browser Extension are operational and fully functional within four mandatory DLA environments (DoD/DLA PKI/PKE, DoD/DLA Cybersecurity,

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED
The Government will assess the procurement environment to determine compatibility with DLA requirements and the ability to promote competition to the maximum extent practicable. DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government as a continuing effort within DLA. DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition.
