About this file

This document is a Justification and Approval for Use of Other Than Full and Open Competition (J&A) for a sole source contract action under solicitation N00024-23-C-4407 for the USS ANCHORAGE (LPD 23) Fiscal Year 2023 (FY23) Dry-Docking Selected Restricted Availability (DSRA).

The J&A authorizes the addition of one new work item for the inspection and repair of the Ship Service Diesel Generator (SSDG) Exhaust System Piping on the USS ANCHORAGE (LPD 23) to be performed by the incumbent contractor, National Steel and Shipbuilding Company (NASSCO). The total estimated value of the new work item is . The repair work must be completed by to support the ship's delivery date of . The J&A cites the statutory authority of 10 U.S.C. 3204(b)(B) as the basis for the sole source award, as the work can only be performed by NASSCO who is already under contract for the broader DSRA effort. No other solicitation or competition is planned due to the time-sensitive nature of the requirement and the need to maintain continuity with the existing work on the ship.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(b)(B) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 this authority applies in those situations where the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

Request for Contractor Change (RCC) 327N was issued to incorporate new work item 342-11-001 to inspect and repair Number 1-5 Ship Service Diesel Generators (SSDGs) exhaust system piping located in Auxiliary Machinery Room Number 1 (7-33-0-E), Auxiliary Machinery Room Number 2 (7-80-0-E) and Auxiliary Machinery Room Number 3 (7-128-0-E) onboard the USS ANCHORAGE (LPD 23). RCC 327N was written to include NAVSEA Standard Items (NSI) 009-11 to accomplish insulation and lagging and 009-32 for cleaning and painting requirement for all new and disturbed surfaces following the repair of five (5) SSDG Exhaust System Piping.

SWRMC C242 conducted structural inspection onboard the USS ANCHORAGE (LPD 23) in

, at which time the leaks in the exhaust pipes was discovered. The ship did not identify the need to repair the exhaust pipes until after 100% Package Lock, therefore this work was not included in the basic work pack.

After 100% package lock, the team researched and found that the Outlet on the Turbo for the MPDE is the separation boundary between the MPDE and the Exhaust system/piping. These are two different systems with their own each unique Ships Work Line Item Number (SWLIN). The exhaust system. The SWLIN for the SSDG is 31211, while the Exhaust SWLIN is 34200. The Exhaust System and not part of the SSDG system, and therefore is considered new work.

The repair of the Exhaust System Piping cannot be deferred to another availability. This work is operational for Sea Trials and AC. Issuing this new work to NASSCO is logical due to the ship being locat issuing this new work will reduce overall risk in terms of cost and schedule on behalf of the Government. Since USS ANCHORAGE (LPD 23) FY23 DSRA was awarded to NASSCO as the prime contractor, having NASSCO accomplish this new work will give continuity with the systems and personnel already scheduled to be working on the ship. Additionally, NASSCO is uniquely positioned to perform this work on the ship and it is impracticable for another company to perform these support services.

The most recent scope of work under RCC 327N (REV-1) was issued to the Contractor for pricing on 23 January 2024. Prior to NASSCO submitting a proposal on 01 February 2024 for , several discussions were held between the Government Project Team and the Contractor to verify scope and verify the necessity of subcontractor support. Neither subcontractor was able to provide a nternal review process was and terms and conditions are accurate and deemed fair and reasonable.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE

The original contract was awarded competitively in which NASSCO was the selected awardee.

Efforts to solicit offers or compete this requirement were not made due to the risks of schedule impact and risk for financial injury as detailed above. During this window of maintenance no other source schedule. An impact to the availability completion schedule would pose a serious risk to mission readiness.

DETERMINATION OF FAIR AND REASONABLE COST

The Contracting Officer has determined that the anticipated cost to the Government of this acquisition will be fair and reasonable based on cost and price analysis to be conducted pursuant to FAR Part 15.

In addition, technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost, and subcontractor cost correspond with the expected cost or Independent Government Estimate (IGE). The basis of estimate for the IGE was developed utilizing the SWRMC market is well known to the contracting officer based on her in-depth experience in the field.

7. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION

This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.
