About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for the FEMA Generator Program managed by Defense Logistics Agency (DLA) Troop Support Construction and Equipment Supply Chain. The document justifies a second bridge action to extend five existing contracts from December 20, 2024 to June 8, 2025 (170 days).

The program provides generator lease/rental services with a maximum value of $900 million through five incumbent contractors: ADS, Berger/Cummins JV, Caterpillar, Inglett & Stubbs International, and Texas Power & Associates. The contractors provide rapid deployment of generators for FEMA disaster relief operations, including assessments, hauling, installing, operation, service, and maintenance services. The program covers CONUS, Alaska, Hawaii, Puerto Rico, Northern Mariana Islands, American Samoa, Guam, U.S. Virgin Islands, and U.S. minor Outlying Islands. The justification cites 10 U.S.C. 3204(a)(1)/FAR 6.302-1 (Only One Responsible Source) as authority, and notes that the follow-on third generation acquisition was solicited in October 2023 with future solicitations to be issued on a full and open competition basis.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

FEMA GENERATOR PROGRAM

1. Defense Logistics Agency (DLA), Troop Support, Construction and Equipment (C&E)

Supply Chain, is the contracting activity.

2. The action being approved is the second bridge action to modify the set of previously awarded competitive contracts under the Federal Emergency Management Agency (FEMA) Generator Program to extend the period of performance by an additional 170 calendar days. The original final performance for the five (5) contracts that support the program was June 23, 2024. The first bridge action extended the expiration date via modification to December 20, 2024. The second bridge action will extend the expiration date via modification to June 8, 2025.

3. The FEMA Generator Program is a competitively awarded multiple award program with post-award competition of delivery orders. The current contracts represent the second (2nd) generation of the FEMA Generator Program. The five (5) contracts, SPE8EG-19-D- 0112 with ADS, SPE8EG-19-D-0113 with Berger/Cummins JV, SPE8EG-19-D-00114 with Caterpillar, SPE8EG-19-D-0115 with Inglett & Stubbs International, and SPE8EG- 19-D-0117 with Texas Power & Associates, were awarded on June 24, 2019 with a five

(5) year base term. Contracts were extended via the first bridge modification for 180-

There will be no changes to the support supplied under the contracts and program. The FEMA Generator Program contracts provide the rapid deployment of generators via lease/rental to support FEMA disaster relief operations. To provide back-up support in the event of catastrophic emergencies, contractors may be requested to provide the following types of support services: assessments, hauling, installing, operation, service, and maintenance.

The current program maximum is $900 million

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. The use of this authority is necessary because the current bridge period is set to expire on

December 20, 2024, The National Response Framework (NRF) is a guide to how the Nation responds to all types of disasters and emergencies. FEMA is responsible for leading the government’s response activities. The NRF includes Emergency Support Function (ESF) which are resources organized into fifteen (15) categories and provides the structure for grouping functions most frequently used to provide Federal support. Generators fall under Emergency Support Function #7 – Logistics Management and Resource Support. Under this ESF, FEMA provides logistics support for moving meals, water, or other commodities such as generators.

The FEMA Generator Program supports a contingency/emergency response. The program provides generators when the nearest FEMA generator fleet has a shortfall in inventory or does not have the generator sizes or quantities in inventory when an emergency response is required. The Contractor is responsible for all transportation to and from all shipping destinations. Delivery is directly to the point of need, intermediary locations, and/or consolidation points in CONUS, Alaska, Hawaii, Commonwealths (Puerto Rico and The Northern Mariana Islands), and Territories (American Samoa, Guam and U.S. Virgin Islands). US minor Outlying Islands may also require support.

FEMA does have the anticipated size ranges for which they need support. However, as with most disaster relief operations, FEMA will not know the actual shortfall until the assessment in field. To provide back-up support in the event of catastrophic emergencies, contractors may be requested to provide the following types of support services: assessments, hauling, installing, operation, service, and maintenance. This feature provides backup to the United States Army Corps of Engineers (USACE) Advance Contracting Initiative (ACI), which provides this support as part of the NRF and ESF #3 – Public Works and Engineering. Under this ESF, USACE installs generators and provides other temporary emergency power sources for health and medical facilities.

The follow-on acquisition represents the third (3rd) generation of the FEMA Generator Program.

6. The follow-on requirement was published to Contract Opportunities. In addition, this justification will be made available for public inspection after award, in accordance with FAR 6.305(a).

7. As the Contracting Officer, I hereby determine that the anticipated cost to the

Government will be fair and reasonable.

8.

No additional research will be conducted, and no other firms will be solicited since the required supplies and services are only available from the incumbent contractors in the required timeframe.

9. There are no other facts supporting the use of other than full and open competition.

10.

11. The acquisition for the follow-on initiative was solicited in October 2023.

Future solicitations are expected to be issued on a full and open competition basis.

12. As the Contracting Officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
