About this file

This is a Justification and Approval (J&A) for use of other than full and open competition for a contract modification.

The Naval Facilities Engineering Systems Command (NAVFAC) Europe Africa Central seeks to increase the maximum value of an existing Indefinite Delivery Indefinite Quantity (IDIQ) Job Order Contract (JOC), contract N33191-20-D-0811, by $9,577,700, raising the ceiling from $75,000,000 to $84,577,700. The modification maintains uninterrupted construction capability at Camp Lemonnier, Djibouti (CLDJ). The IDIQ JOC provides streamlined, on-demand construction services including renovation, repair, demolition, and new construction for airfield, waterfront, and infrastructure projects valued between $2,000 and $8,000,000. As of March 20, 2026, the remaining contract capacity is $9,136,300; however, identified third quarter requirements total $18,714,000, creating a projected shortfall of $9,577,700. The 16 planned projects span Q2 and Q3 2026 and include sewage system repair, roof replacement, HVAC rebalancing, building painting, retaining wall repair, hanger door replacement, airfield pavement repair, power installation, and micro grid construction.

The modification is justified under 10 U.S.C. 3204(a)(1) based on the incumbent contractor being the only responsible source capable of providing immediate, continuous construction execution without unacceptable delay. The incumbent possesses unique qualifications including an established, fully staffed workforce currently operating at CLDJ; existing base access and operational permissions; an established local supply chain; demonstrated JOC task order response capability; and CLDJ-specific infrastructure knowledge. The current JOC ordering period expires September 27, 2026, and the follow-on JOC award is anticipated August 14, 2026. A sources sought notice was posted on SAM.gov on March 24, 2026, but no responding vendor demonstrated the ability to mobilize, obtain authorizations, and begin performance within the required timeframe. The Contracting Officer determined the anticipated cost to the Government is fair and reasonable, and the Government is actively pursuing full and open competition for the follow-on JOC to eliminate future sole-source reliance.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. Naval Facilities Engineering Systems Command (NAVFAC) Europe Africa Central (EURAFCENT), Resident Officer in Charge of Construction (ROICC), Camp Lemonnier Djibouti (CLDJ).

2. Description of the Action Being Approved. Award of a modification to increase the maximum value of Indefinite Delivery Indefinite Quantity (IDIQ) Job Order Contract (JOC), contract N33191-20- D-0811 by $9,577,700 from $75,000,000 to $84,577,700 to maintain uninterrupted construction capability at Camp Lemonnier, Djibouti.

3. Description of Supplies/Services. This Indefinite-Delivery Indefinite-Quantity JOC provides a streamlined, on-demand vehicle for executing construction services at CLDJ. The work primarily consists of renovation, repair, demolition, and new construction for airfield, waterfront, and infrastructure projects valued between $2,000 and $8,000,000.

This contract action is required to maintain continuous task order execution capability for mission-essential construction requirements and prevent a disruption in project awards pending award and mobilization of the follow-on JOC. The remaining capacity of the JOC as of 20 March 2026 is $9,136,300; however, identified third quarter requirements total $18,714,000 (see table below), resulting in a projected shortfall of approximately $9,577,700, necessitating this increase in contract capacity.

4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C.

3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority. The authority cited under 10 U.S.C.

3204(a)(1) is appropriate because the incumbent JOC contractor is the only responsible source capable of meeting the Government’s requirement for immediate, continuous construction execution at CLDJ without unacceptable delay.

The requirement is not solely for construction services, but for the immediate execution of multiple task orders through an established, fully operational JOC vehicle with a contractor that is already mobilized, licensed, and actively performing work at CLDJ. The incumbent contractor possesses unique qualifications that no other source can replicate within the required timeframe, including:

An established, fully staffed, and trained workforce currently operating at CLDJ Existing base access, badging, and operational permissions required to perform work on Camp

Lemonnier An established local supply chain and logistics network within Djibouti Demonstrated capability to respond to JOC task orders within required timelines Familiarity with CLDJ-specific requirements, infrastructure, and operational constraints

The current JOC ordering period expires on 27 September 2026 and has only $9,136,300 in remaining capacity. The Government has already initiated solicitation of the first ten (10) projects, which will fully exhaust the remaining contract capacity. Six (6) additional mission-essential projects, valued at approximately $9.6 million, must be solicited and awarded during the third quarter and cannot be deferred without negatively impacting mission readiness.

The follow-on JOC is anticipated for award on 14 August 2026. However, even upon award, a new contractor—if other than the incumbent—would require a significant mobilization period to obtain necessary licenses, establish a workforce, secure supply chains, and gain operational access to CLDJ.

This mobilization period would create an unacceptable gap in the Government’s ability to execute construction requirements.

No other contractor is capable of meeting the requirement for immediate continuity of services within the required timeframe. While construction services themselves are commercially available, the combination of existing presence, mobilization readiness, and ability to execute immediately under an active JOC contract at CLDJ is unique to the incumbent contractor.

Attempting to procure these requirements through stand-alone contracts or alternative vehicles would not satisfy the Government’s need for immediate execution, as such approaches would require procurement lead time, contractor mobilization, and administrative actions that would delay project
