About this file
This is a Justification and Approval (J&A) document for the use of other than full and open competition in federal contracting.
The Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC) Hawaii seeks to extend the Small Business Architect-Engineer (A-E) Services Indefinite Delivery Indefinite Quantity (IDIQ) Contract No. N62478-20-D-5037 awarded to Fukunaga and Associates, Inc. (FAI) through a four-month bridge contract from September 11, 2026 through January 10, 2027, with an optional three-month extension through April 10, 2027. The contract provides design and engineering services for utility projects and other projects at various locations under NAVFAC Hawaii's cognizance, including Military Construction (MILCON) project documentation, functional analysis and concept development workshops, design-build and design-bid-build contract documents, cost estimates, technical surveys, hazardous material assessments, comprehensive interior design services, and post-construction award services. The total estimated contract value is $72,000,000, inclusive of two prior capacity increases totaling $42,000,000, with no additional capacity requested for the bridge extension.
The justification cites Title 10 USC § 3204(a)(1) and FAR 6.103-1 as authority for the non-competitive action, asserting that only FAI is the responsible source capable of continuing these services without interruption. The bridge extension is necessary because NAVFAC Hawaii's follow-on competitive procurement was delayed—the initial synopsis posted in September 2025 did not receive the required minimum of three qualified responses, requiring re-solicitation in May 2026 with anticipated award no later than December 2026. The J&A notes that FAI is the only existing contract vehicle available for sustainability, restoration, and maintenance utility engineering services, and NAVFAC Hawaii plans to eliminate future competition barriers by competitively awarding a new small business set-aside IDIQ for Utility Projects with anticipated award in the first quarter of Fiscal Year 2027.

NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, HAWAII
400 MARSHALL ROAD
JBPHH, HAWAII 96860-3139
IN REPLY REFER TO:
J&A No. 26-70
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC), Hawaii, Architect-Engineer (A-E) Contracts Branch (Code CON33), Joint Base Pearl Harbor-Hickam (JBPHH), Hawaii.
2. Description of the Action Being Approved.
NAVFAC Hawaii intends to use a bridge contract to provide continuation of A-E Services for Utility Projects under A-E Services Small Business Indefinite Delivery Indefinite Quantity (IDIQ) Contract No. N62478-20- D-5037 for Various Utility Projects and Other Projects Primarily Under the Cognizance of NAVFAC, Hawaii, Various Locations.
The contract is currently in final option year expiring 10 September 2026 inclusive of a six-month extension under 52.217-8 OPTION TO EXTEND SERVICES Clause, a six-month bridge contract extension and a three-month exercised option. The total estimated contract value is $72,000,000 which is inclusive of two capacity increases totaling $42,000,000.
The bridge contract extension request is for four months from 11 September 2026 through 10 January 2027. This action will also include one (1) three-month option that could extend the period of performance until 10 April 2027 if exercised. No additional capacity is being requested.
3. Description of Supplies/Services.
This Small Business A-E services IDIQ for Utility Projects was awarded to Fukunaga and Associates, Inc. (FAI) on 11 June 2020, with a base year and four one-year options. The contract is currently in final option year expiring 10 September 2026 inclusive of a six-month extension under 52.217-8 OPTION TO EXTEND SERVICES Clause, a six-month bridge contract extension and a three-month exercised option. The total maximum not-to-exceed value of $72,000,000 is inclusive of two capacity increases totaling $42,000,000.
The work under this A-E services IDIQ includes design and engineering services for various utility projects and other projects at various locations under the cognizance of NAVFAC Hawaii; however, on special occasions, work may also be required in other areas outside of Hawaii.
Specified design and engineering services for utility and other projects include execution and delivery of Military Construction (MILCON) project documentation (DD Form 1391); Functional Analysis and Concept Development (FACD) workshops/design charrettes; Design-Build (DB) Request for Proposal (RFP) solicitation documents; Design-Bid- Build (DBB) design contract documents; SPECSINTACT program; cost estimates utilizing the Micro-Computer Aided Cost Estimating System Second Generation (MII) cost estimating system; technical surveys and reports including concept studies, site engineering investigation, topographical survey, geotechnical investigation, hazardous material survey, Munitions of Explosive Concern survey, hydrographic survey, and others; Collateral Equipment Buy Packages; Comprehensive Interior Design (CID) including Structural Interior Design (SID) and Furniture, Fixtures, and Equipment (FF&E); and Post Construction Award Services
(PCAS).
FAI has been successful on the contract and is recommended to continue providing utility engineering services.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is Title 10 USC § 3204(a)(1), as implemented by Federal Acquisition Regulations (FAR) 6.103-1 Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
A bridge contract is necessary to allow time for NAVFAC Hawaii to complete the ongoing procurement of the follow-on contract. The original synopsis action for the follow-on procurement was posted in September 2025, with an SF330 response due date in October 2025 which was amended to November 2025. The number of SF330 responses received that were qualified to be slated did not meet the Selection of Architects and Engineers Statute requirement of a minimum of three (3). The procurement was amended to be less restrictive and posted again in May 2026 with a SF330 response due date in June 2026. Due to this delay, the follow-on procurement is now anticipated to be awarded no later than December 2026.
The SBSA Utility Engineering Services IDIQ contract is the only existing contract vehicle that allows for the procurement of sustainability, restoration and maintenance (SRM) utility engineering services. Without this contract vehicle, there is a high risk of base requirements and critical facilities being left unsupported until the next SBSA Utility Engineering Services IDIQ contract is awarded.
. It is necessary and will be most efficient and cost effective to use the existing contract, N62478-20-D-5037 to secure future projects until the next IDIQ contract is awarded.
6. Description of Efforts Made to Solicit Offers from as Many Offerors As Practicable.
A synopsis of the proposed contract modification was not published in Contract Opportunities (at SAM.gov), pursuant to the exception FAR 5.201(b)(2), where this proposed contract action is made under the terms of an existing contract that was previously posted to the Governmentwide point of entry (GPE). A formal market survey was not conducted as it is not practicable for the reasons discussed in paragraph 5 above, for any firm other than FAI to provide the required follow-on work for additional design and PCAS services, due to the highly specialized nature of A-E services. The Government conducted market research by considering other A-E firms under existing current IDIQ contracts and A-E firms that have SF330s A-E Qualifications on file with the NAVFAC Hawaii A-E Contracts Branch (Code CON33) as available sources to potentially solicit these design and PCAS requirements. After a technical evaluation of three firms qualifications, no firms were identified or determined to be more highly qualified than FAI for the requirements for these projects. It is also believed that no other firm will express a serious interest in the work if that firm is required to assume responsibility and liability for a design that was prepared by another firm.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Action to Remove Barriers to Future Competition.
The previously planned actions to remove barriers to competition were not achieved because the initial milestones were overly optimistic relative to necessary technical and administrative lead times. The revised milestone schedule now includes a three (3) month option period to provide adequate schedule buffer, ensuring sufficient time to complete competitive requirements while mitigating the impact of unforeseen delays. NAVFAC Hawaii plans to eliminate barriers to future competition by competing and awarding a new IDIQ for Utility Projects. This requirement will be solicited as a competitive small business set-aside with an anticipated award in the first quarter of Fiscal Year (FY) 2027.
