About this file
This is a Justification and Approval for Other than Full and Open Competition document for a sole-source procurement by the Defense Microelectronics Activity (DMEA).
DMEA seeks a new Firm-Fixed-Price contract valued at $19,500.00 for the base year with three option years for Kulicke & Soffa (K&S) Ball Bonder Training and Preventive Maintenance. The base year includes a 5-day advanced training course for two operators covering plastic and ceramic package profile bonding parameters, EFO Wand and P-Part installation, and programming procedures, along with initial preventive maintenance. Option years 1, 2, and 3 consist of annual preventive maintenance, calibration, and proprietary software updates for years 2, 3, and 4 respectively. The contract is justified under FAR 6.302-1 (Only One Responsible Source) because Kulicke & Soffa is the Original Equipment Manufacturer and sole proprietor of all proprietary software, diagnostic tools, technical specifications, OEM parts, and certified training curriculum required for the K&S RAPID Pro Ball Bonder. The manufacturer confirmed they do not use resellers or authorized third-party service providers. Market research included direct email inquiries to K&S sales and management and review of documentation from the original equipment purchase (Contract HQ072724P0008). The Contracting Officer, Shawndae Wilkins, certified the justification as accurate and complete and determined the anticipated cost to be fair and reasonable. The contract contact for Kulicke & Soffa is Christopher Morrison (cmorrison@kns.com).

Defense Microelectronics Activity 4234 54th Street, McClellan, CA 95652
SOW/PWS # 26-6E6
Justification and Approval for Other than Full and Open Competition
1. Agency and Contracting Activity: Office of Secretary of Defense, Defense Microelectronics Activity (DMEA).
2. Nature/Description of Action: This is a new Firm-Fixed-Price (FFP) contract in the amount of $19,500.00 for a base year and three option years for Kulicke & Soffa (K&S) Ball Bonder Training and Preventive Maintenance (PM). Anticipated structure is as follows:
Base Year: 5-day advanced training for two operators and initial Preventive Maintenance (PM).
Option 1: Annual PM, calibration, and software updates for Year 2.
Option 2: Annual PM, calibration, and software updates for Year 3.
Option 3: Annual PM, calibration, and software updates for Year 4.
3. Description of Supplies/Services: DMEA is seeking Advanced Wire Ball Training and Preventive Maintenance (PM) for the recently acquired K&S RAPID Pro Ball Bonder installed at DMEA. The contractor shall provide a 5-day advanced training course for two operators covering plastic and ceramic package profile bonding parameters, EFO Wand and P-Part installation, and correct programming steps. Additionally, the contractor will provide annual preventative maintenance, periodic calibrations, replacement of all high-wear items to return the machine to Original Equipment Manufacturer (OEM) specifications, and any necessary proprietary software upgrades.
4. Authority Cited:
FAR 6.302-1, Only One responsible Source and no other supplies or services will satisfy agency requirements under the authority of 10 U.S.C 2304(c)(1) or 41 U.S.C. 3304(a)(1).
5. Reason for Authority Cited: The K&S RAPID Pro Ball Bonder is a highly specialized, proprietary piece of equipment critical to completing Microcircuit Assembly (MCA) projects at DMEA. Kulicke & Soffa (K&S) is the Original Equipment Manufacturer (OEM) and holds all proprietary rights to the software, diagnostic tools, and technical specifications required to properly maintain, calibrate, and upgrade the equipment.
Direct correspondence with K&S confirmed that they are the sole proprietor and exclusive provider of all maintenance, proprietary software updates, and advanced training for their equipment. K&S explicitly stated they do not use resellers or have any authorized third-party service providers. Procuring these services from any other source is impossible as no other vendor has access to the proprietary software, OEM parts, or certified training curriculum.
Utilizing the OEM ensures the equipment remains 100% operational and prevents voiding any warranties or causing damage to the machine through improper third-party handling.
DMEA # 26-16
6. Efforts to Obtain Competition: Direct inquiries were made to the manufacturer to determine if authorized third-party vendors or resellers existed. K&S confirmed they do not have authorized resellers or service providers for these requirements.
7. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.

8. Market Research: Market research was conducted through direct email correspondence with Kulicke & Soffa (K&S) sales and management to inquire about authorized resellers, distributors, or third-party service providers. Furthermore, the sole-source justification and market research conducted for the original equipment purchase (Contract: HQ072724P0008) was reviewed. The research unequivocally demonstrates that K&S is the only company capable of providing the proprietary training, OEM parts, and software updates required.
9. Other Facts: The equipment being serviced (K&S RAPID Pro Wire Bonder) was recently acquired by DMEA via a sole-source procurement (Contract: HQ072724P0008) because it was the only equipment that met DMEA's highly specific technical requirements.
10. Listing of Sources:
Kulicke & Soffa (KnS) Christopher Morrison, cmorrison@kns.com
11. Actions to Increase Competition: No actions have been taken to increase competition as this is a sole source procurement.
12. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
