About this file
This is a Single Source Justification (SSJ) for a simplified acquisition by the Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management on behalf of Enforcement Removal Operations (ERO), Buffalo Field Office.
ICE/OAQ proposes to award a firm-fixed price purchase order to Escarpment Arms, Inc. (3580 Lockport Olcott Road, Lockport, NY 14094) for the rental of an outdoor firing range facility to accommodate approximately 80 ICE/ERO officers for their quarterly firearms qualifications during the 1st, 3rd, and 4th quarters, with officers completing winter qualifications at an indoor facility during the 2nd quarter. The base requirement consists of 40 days of facility rental at a specified daily rate, plus 20 optional days at the same rate. The total estimated cost for the base period plus two 12-month option periods with a 4.5% annual escalation rate is redacted in the document. The facility must provide 25, 50-, and 100-yard firearms lanes in the metropolitan Buffalo, NY area. Escarpment Arms, Inc. is identified as the only known vendor with current available capacity to meet this requirement. Other local facilities (Tonawanda Sportsmen's Club, Niagara Gun Range, and Erie County Sheriff's Department range) are either unwilling to contract with ICE, fully committed to other federal agencies (CBP and FBI), or lack sufficient capacity. The proposed price is deemed fair and reasonable based on comparison with the vendor's previous pricing under a prior purchase order, adjusted for a 2.9% annual escalation rate.

Rationale:
Escarpment Arms, Inc. is the only known vendor with the capacity currently available to accommodate up to 80 ICE/ERO Officers, and that provides 25, 50- and 100-yard firearms lanes in metropolitan Buffalo, NY. There are three other local outdoor firing ranges that offer facilities that could fulfill the ICE requirement. However, these facilities do not currently have available capacity necessary to accommodate ICE. The previous vendor, Tonawanda Sportsmen’s Club, Inc., has confirmed that it does not want to continue its business relationship with ICE, and will not submit a quote for the subject requirement. For over 30 years, ICE/ERO officers have completed their quarterly training (to maintain their firearms qualifications) at the Tonawanda Gun Range. Recently, a new club President was appointed. This new President notified ICE they were unwilling to entertain the idea of a new contract because the club members were upset at the number of days the ICE/ERO was using the at the range.
The Niagara Gun Range is under contract full-time Monday through Friday during business hours with Customs and Border Protection (CBP). CBP has 700 officers in the Buffalo area so they have contracted for full-time operation of this facility and it is not available for ICE use.
The Erie County Sheriff’s Department also owns an outdoor firing range that could also meet ICE requirements. However, this facility is currently unable to rent the space to ICE due to their own demand (they have over 1,000 officers) and this facility also rents its remaining spare capacity the to the Federal Bureau of Investigation (FBI).
Additionally, the program office contacted Ten-X, an outdoor firing range located in Akron, NY, but the facility is a private gun club with limited business hours (open only to members for tournament use and weekend events) and is not registered in SAM.
Aside from the aforementioned facilities, there are no other known outdoor firing ranges located in metropolitan Buffalo, NY that offer 25, 50- and 100-yard firearms lanes.
