About this file

This Justification and Approval (J&A) document supports a sole-source, three-year indefinite-delivery/indefinite-quantity (IDIQ) contract for performance-enhancing drug (PED) testing for the Department of Defense Drug Demand Reduction Program (DDRP). The contract will be awarded to Sports Medicine Research and Testing Laboratory (SMRTL) for a total ceiling cost of $12,078,900.00, with initial FY 2025 funding of $3,999,970.00. The laboratory will perform urinalysis testing for anabolic steroids and other PEDs listed in the World Anti-Doping Agency Code, with an annual capacity of up to 19,000 initial tests and 1,140 Isotope Ratio Mass Spectrometry tests.

The sole-source justification is based on market research revealing only two WADA-accredited laboratories in the continental United States, with UCLA Olympic Analytical Laboratory declining to pursue the opportunity. The contract requires the laboratory to test specimens in batches of up to 350, provide 40 hours of expert telephonic consultation, and deliver test results within 7-10 business days. The contract will run from 24 August 2025 through 23 August 2028, continuing services currently performed under the existing contract N6264523D5012.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: The requiring activity is

Navy and Marine Corps Force Health Protection Command (NMCFHPC), Portsmouth, VA in support of the

Department of Defense Drug Demand Reduction Program (DDRP). The contracting activity is the Naval Supply

Systems Command Fleet Logistics Center Norfolk.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a sole source action to be issued as a new indefinite-delivery/indefinite quantity (IDIQ) contract to test for performance enhancing drugs (PEDs). The resultant contract will be an IDIQ vehicle under which firm-fixed-price (FFP) task orders will be issued. The contract will have a three-year ordering period from 24 August 2025 through 23 August 2028. The Independent Government

Estimate is for a ceiling cost of $12,078,900.00.00 over the three-year ordering period. This procurement action supports services that are currently performed under Contract N6264523D5012. Contract N6264523D5012was awarded on a competitive basis to Sports Medicine Research and Testing Laboratory, a large business; the existing contract’s ordering period expires on 24 August 2025.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is to provide to the

Government all labor, materials, facilities, and equipment necessary to analyze the human urine specimens for anabolic steroids, as defined in the Designer Anabolic Steroid Control Act of 2014, including subsequent amendments and all performance enhancing substances listed on the Office of the Under Secretary of Defense

Memorandum “Department of Defense Special Drug Testing Panel,” April 24, 2024. The laboratory performing the testing shall reside in the continental United States (CONUS), furnish all labor, equipment, materials, and facilities to perform anabolic steroid and other Performance Enhancing Drugs (PEDs), explicitly listed in Classes S1, S2 and

S4 of the World Anti-Doping Agency Code (WADAC) Prohibited List testing on human urine specimens under the forensic and scientific specifications of the WADAC and the Department of Defense (DoD) Drug Demand

Reduction Program (DDRP) Instructions. NMCFHPC has provided Fiscal Year (FY) 2025 Operation &

Maintenance, Navy (O&MN) funding in the amount of $3,999,970.00 to meet the minimum expected testing levels for the contract.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

The statutory authority which permits restricting sources is 10 U.S.C. 3204 (a)(1) - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, which is implemented by FAR 6.302-1. The

Department of the Navy (DON) is not required to provide for full and open competition if: (i) There is only one or a limited number of responsible sources; and (ii) No other supplies or services will satisfy the DON’s requirements.

5. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF

CONTRACTOR’S UNIQUE QUALIFICATIONS: The DoD DDRP is responsible for enabling operational readiness, safety, and security of the Total Force by deterring drug abuse through robust and dynamic drug testing;

emerging drug threat surveillance; prevention, education, and outreach efforts; and development of new testing procedures.

To enable these efforts, DDRP requires a follow-on to performance-enhancing drug (PED) testing with specified essential characteristics:

1. A domestic World Anti-Doping Agency (WADA) accredited and performance enhancing drug testing laboratory is required. The WADA accredited laboratory shall provide urinalysis testing for all substances listed on the Office of the Under Secretary of Defense Memorandum “Department of Defense Special Drug

Testing Panel,” April 24, 2024.

2. The laboratory shall accommodate annually up to 19,000 initial tests for performance enhancing drugs

(PED). In addition to PED tests, this shall also include up to 1,140 Isotope Ratio Mass Spectrometry

(IRMS) tests. The vendor shall be able to test specimens in batches, not to exceed three hundred and fifty

(350) specimens. The vendor shall also be able to provide forty (40) hours of expert telephonic consultation.

3. The vendor shall be able to provide a priority testing procedure to accommodate turnaround time requirements of the government. This shall include priority testing procedure with report results being reported within 7 business days on average, but not to exceed 10 business days.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a

Description of Market Research, if applicable, and a List of Interested Sources, if any.

Market research was conducted in accordance with FAR Part 10. DDRP acquired a list of accredited laboratories for doping control analysis from the World Anti-Doping Agency. As of 01 May 2025, there are two (2) accredited

WADA laboratories located within the continental United States.

UCLA Olympic Analytical Laboratory (UCLA) 2122 Granville Avenue

Los Angeles, CA 90025

The Sports Medicine Research and Testing Laboratory (SMRTL)

10644 South Jordan Gateway

Salt Lake City, UT 84095

Both laboratories identified above were contacted and confirmed their ability to test PEDs in accordance with the

Performance Work Statement and Essential Characteristics, as part of the customer’s market research. On 25 March

2025, UCLA expressed interest and indicated that a quote would be provided at a future time. On 30 April 2025, in accordance with PGI 206.302-1(d), a Sources Sought notice was posted to the Government Point-of-Entry (GPE) on

SAM.gov, in the interest of ensuring there are no other unlisted entities that have access to an accredited laboratory to perform the tests. On 30 April 2025, the contract specialist contacted UCLA, as a courtesy to let them know that the Sources Sought notice had been posted. On 14 May 2025, UCLA was again contacted by the contract specialist and was given a deadline of 16 May 2025 to reaffirm capability and/or interest in the requirement. UCLA did not respond to the 14 May 2025 inquiry. UCLA ceased future communication with the Government after its initial indication of interest in the requirement, on 25 March 2025. SMRTL was the only qualified entity, with access to a

WADA-accredited laboratory, to respond to the relevant Sources Sought notice. Further, SMRTL is the current incumbent performer, via a competitive solicitation on 24 August 2023. Considering the aforementioned details, it is recommended that this requirement be solicited on a sole-source basis to SMRTL.

7. DETERMINATION OF FAIR AND REASONABLE COST. The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: As previously mentioned, on 30 April

2025 a Sources Sought Notice was posted to the GPE on SAM.gov. Furthermore, the contracting activity and the customer will continue communications with World Anti-Doping Agency to ensure an updated list of accredited laboratories is always provided. All future requirements will be handled on a case-by-case basis.

9. CONTRACTING POINT OF CONTACT: The point of contact at NAVSUP FLC Norfolk, Contracting

Department, is Austin Waller, Austin.p.waller.civ@us.navy.mil.
