About this file

This justification and approval document authorizes a sole source procurement of specific brand name facility related control system network equipment from Distech in the amount of $117,926 to replace the recruit mess hall at Marine Corps Recruitment Depot San Diego. The network equipment models listed, including routers, switches, field controllers and temperature sensors, must be purchased due to compatibility with the installation-wide control system infrastructure and to meet cybersecurity requirements for the system's authority to operate accreditation from Naval Facilities Engineering Command Headquarters. While other manufacturers offer comparable products, only the stated Distech models meet test and configuration requirements for the existing certified system into which the new mess hall network must integrate.

2. Description of Action being Approved

This project-specific Justification and Approval (J&A) authorizes and approves the procurement of the only brand-name Facility Related Control System (FRCS) network equipment from Distech that complies with the Marine Corps Recruitment Depot (MCRD) cybersecurity requirements for project P-315 Mess Hall Replacement at Marine Corps Recruitment Depot San Diego.. The approval applies to brand-name equipment that is tested/inspected/maintained/sustained by Utilities and Energy Management Public Works at MCRD. The estimated P315 MESS HALL project cost for the equipment collectively is $117,926. This amount is only a nominal percentage, approximately of the overall cost for the project (currently estimated at ).

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Project P315 requires specific network equipment to allow the newly provided FRCS system to tie into the existing MCRD network that hosts the Installation-wide FRCS infrastructure utilized for monitoring, billing, and recording of data for energy management and control. The specified brand name products are required to be purchased in order to be compatible with the pending NAVFAC FRCS Authority to Operate (ATO) accreditation required. The FRCS network at MCRD is installed in conjunction with NAVFAC Headquarters (HQ). NAVFAC HQ holds Platform Information Technology (PIT) certification for FRCS. ATO certification is achieved through a rigorous Risk Management Framework process in accordance with Unified Facilities Criteria 4-010-06 Cybersecurity of Facility Related Control Systems to reduce and mitigate vulnerabilities until the risk is acceptable to the System Owner and Authorizing Official. While there are other manufacturers of comparable materials, the specific brand-name equipment listed above are the exact models that are required in order to be in compliance with the existing accreditation process.

The aforementioned brand/make/models of network equipment are the only ones tested and currently installed. DoD Instruction 8500.01 requires that all PIT systems have their cybersecurity controls documented and validated prior to operation and/or deployment.

The use of the brand name components that have been previously included in the current Energy Monitor and Control System avoids significant costs and delays associated with obtaining a new certification for additional network equipment which, due to government information technology cybersecurity risks, is required when additional nonconforming hardware or software is added to the system with resultant changes in the security posture of the system. The process of obtaining a new ATO would unacceptably delay the operational use for the affected facility and connection of the facility to the existing networks, resulting in a significant degradation in accomplishment of mission.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The specific brand-name products are required, but the products can be purchased from more than one distributor and multiple resellers of these items exist. These products are commercial-off-the-shelf and should be available for purchase through any vendor. In accordance with FAR 6.302-1, the approved J&A will be posted on SAM.GOV at the time of solicitation.

7. Determination of Fair and Reasonable Cost

Based on the historic cost information currently available, the Contracting Officer has adequate information to ensure that the cost to the Government for this acquisition will be fair and reasonable.

8. Actions Taken to Remove Barriers to Competition

Currently, there is no other brand-name equipment available that meets the requirements of the impending accreditation for the FRCS Network. NAVFAC HQ is continuously evaluating new commercial hardware to increase brand diversity and may add new brand/make/models to the ATO accreditation as soon as alternatives become available.
