About this file

This Justification and Approval (J&A) document is for a non-competitive contract award to RSMeans Data from Gordian by the Transportation Security Administration's (TSA) Direct Leasing Branch and Real Estate Management Division (REMD). The contract is for a firm fixed-price construction cost estimating software with a two-year base period and a 12-month option period, funded by Operations and Support funds for Fiscal Year 2025.

RSMeans will provide comprehensive construction cost data and estimating software with capabilities including detailed cost estimation, budgeting, project planning, benchmarking, and bid preparation. The agency determined RSMeans was the sole vendor capable of meeting their requirements after conducting market research through a Request for Information, with one other vendor indicating they would need to build a database from scratch. The contract is being awarded under the statutory authority of 10 U.S.C.3204(a)(1), which allows for a sole source procurement when only one responsible source can satisfy agency requirements.

JA-2025-01-1192

Estate Management Division (REMD) due to RSMeans’ ability to provide REMD with access to a comprehensive database of construction costs data. No other estimating software has been used.

After completion of the previous contract, REMD was forced to manually calculate construction cost estimates for material, labor, equipment, as well as construction cost projections.

4. Description of Supplies/Services.

RSMeans is a comprehensive source of construction cost information, providing accurate and up-to-date cost data for various construction projects. The primary purpose of RSMeans is to aid in the planning, budgeting, and estimating phases of construction projects. Several key functions include:

a. Detailed Cost Estimation: RSMeans provides detailed cost data for materials, labor, and equipment, helping contractors, architects, and engineers to develop accurate cost estimates for construction projects.

b. Budgeting: By offering reliable cost information, RSMeans assists project managers and financial planners in creating and managing project budgets effectively.

c. Project Planning: RSMeans data helps in scheduling and planning construction activities by providing insights into the time and resources required for different tasks.

d. Benchmarking: The data can be used to compare costs across different regions and project types, enabling stakeholders to benchmark their projects against industry standards.

e. Bidding: Contractors and subcontractors use RSMeans data to prepare competitive bids for construction projects, ensuring that their proposals are based on accurate and current cost information.

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C.3204(a)(1) implemented by the FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstration that the Nature of the Acquisition Requires Use of the Authority Cited.

RSMeans was the only vendor to respond to Request for Information (RFI) 70T01025I7668N264 issued on System of Award Management (SAM) that can provide these services. RSMeans provides current data which is updated regularly to reflect current market conditions. This is important with the constant changing of construction costs.

RSMeans is the only software that could fully accomplish the goals of REMD. The impact of not being able to obtain an estimating software hinders our mission to get timely and accurate estimates. At any given time REMD could be working on over 100 projects stretched across the country, hence the need for an estimating software that can adapt to this type of fast paced environment.

One other vendor, , responded to RFI 70T01025I7668N264.

stated they would need to build this database since they do not currently have the software capability.

6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable.

Request for Information (RFI) 70T01025I7668N264 was issued on SAM on August 14, 2025. TSA received two responses, RSMeans and . RSMeans was the only vendor with the capability to provide estimating software to meet REMD requirements.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.

The Contracting Officer has a reasonable expectation that fair and reasonable pricing can be obtained, using historical data from the previous contract and commercial prices advertised online.

8. Description of Market Research.

Market research was initially conducted through an internet search for any sources providing commercial estimating with the ability to form the software to fit TSA’s specific pricing functions. TSA issued an RFI (70T01025I7668N264) on August 14, 2025. Two vendors responded: RSMeans and . RSMeans was the only vendor who has the capability to meet REMD’s need.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.

can build a new estimating tool. This route would be costly to the Government and would take extensive time to build as well as meet TSA’s Authority to Operate requirement. As RSMeans has provided similar services for other government agencies and can be molded in the specific TSA format, RSMeans is the most viable software.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition. None

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.

For any subsequent acquisition under this requirement, the Government will continue to survey the market to determine if other products can meet the customer support, pricing, and ease of use in the future.

12. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.

Contracting Officer Date

13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
