About this file

This document is a Justification and Approval (J&A) for a non-competitive, sole-source procurement by the Army Contracting Command-Detroit Arsenal (ACC-DTA). The contract is for 70 Fan, Personal Heater units from Ronal Industries, with a total maximum value of $643,440.00, using Army Working Capital Funds. The procurement is justified because the technical data is proprietary to Ronal Industries, who confirmed on 12 April 2024 they were not interested in selling the technical data, and market research showed no alternative sources that could meet the Army's specific requirements for a fan to fit within a crew compartment.

The procurement involves extensive non-recurring engineering efforts estimated at $2.15M, including developing a Technical Data Package (TDP), obtaining part samples, reverse engineering, fabrication, component testing, and vehicle testing. The total timeline for these efforts is 25 months. The government cannot competitively re-procure the item due to Ronal Industries owning the intellectual property rights, and attempting to do so would result in substantial costs and delays. The contract is being awarded under the statutory authority permitting other than full and open competition, specifically citing that only the original source can provide the specialized equipment without unacceptable government cost or delays.

6. Efforts to Obtain Competition:

a. Effective competition: Based on the detailed rationale provided in paragraph 5, there is no plan to obtain competition for this proposed action. All notices required by FAR 5.201 shall be published, and any proposals received shall be considered.

b. Subcontracting competition: Ronal Industries, a small business, will not be required to submit a subcontracting plan and therefore the FAR and DFARS subcontracting clauses will not be included in the resulting contract.

7. Actions to Increase Competition: The technical data required to produce this item is proprietary to Ronal Industries Inc. On 12 April 2024, Ronald confirmed they were not interested in selling the technical data. The Government, however, will continue to monitor Ronal Industries Inc. willingness to sell the data rights for future procurements.

8. Market Research: The Contract Specialist posted the Sources Sought/Request for Information (RFI) onto sam.gov on 29 March 2024. On 08 April 2024, Ronal Industries Inc. the vendor of the of the Fan, Personal Heater; NSN: 4140-00-782-1169; P/N:

10924791, responded to the RFI indicating its capability to produce this asset for the Government. Ronal Industries Inc. also indicated its history of producing this fan under W56HZV-17-C-0001. Meggitt, the other approved source on the part drawing, responded with no interest in producing the item under this contract. No other outside sources responded to the RFI.

In addition to the sources sought notice, an internet-based search was performed by the Engineering Support Activity in April 2024. According to the websites listed below, none of the vendors appear to sell a fan that meets the Army requirements nor the appropriate size to fit within the crew compartment:

9. Interested Sources: To date no additional sources have expressed interest in this item.
