MEMORANDUM FOR INDUSTRY
The Defense Threat Reduction Agency submits feedback on additional industry comments generated from the J10 Nuclear Enterprise Support Directorate Organizations draft versions of the Performance Work Statement, Sections L & M, and the Virtual Industry Day slides.
In an effort to keep the submissions general and brief in nature, some of the questions/comments have been reworded or shortened but the intent of the submissions were left intact.
Questions and Responses on Draft PWS, Draft Sections L & M and Virtual Industry Day Slides
GENERAL QUESTIONS
Subject Area Question / Comment / Feedback Government Response
Organizational Conflict of Interest (OCI)
Recommend an OCI avoidance strategy for the prime and OCI mitigation strategy for subcontractors.
A prime contractor mitigation strategy may appear to allow for greater flexibility in contract execution, but has the potential to hamper or constrain the prime's "trusted agent" role, thus introducing unnecessary program risk.
A mitigation strategy for subcontractors, wherein A&AS subcontractors may provide non-A&AS products and services at the third-tier level of DTRA (Department/separate Division) where subcontractors do not currently provide A&AS, carefully managed by the prime, enables the Government to have access to a broader array of industry capabilities, without undermining or hampering the A&AS team's "trusted agent" role.
The Government appreciates the input and will consider it as it continues the acquisition review process which is ongoing. The Government intends to issue a Draft RFP and a response to these questions in the future.
General / Acquisition Strategy Urge the Government to re-consider breaking up the current J3/7 and J10 A&AS contract due to the increased cost and time involved in managing separate efforts, there are also important OCI issues to take into consideration. An integrated J3/7 and J10 A&AS enables sharing best practices across the two J-Dirs and support aligning business processes, resulting in fewer disparate directorate level processes. The nuclear operations effort separated from and then consolidated back with other DTRA operational capabilities several times. Given that the supported organizations reorganized and/or realigned programs several times since the previous RFP, does the J10 OCI requirement adequately address the potential for internally or externally driven program shifts or mission changes?
The Government appreciates the input and will consider it as it continues the acquisition review process which is ongoing. The Government intends to issue a Draft RFP and a response to these questions in the future.
Acquisition Strategy / Socio-Economic Commitment
Goals
Given the size and scope of J10's technical requirements;
we concur with the Government's intent to procure this support through a full and open competition, which will minimize program risk. We do not foresee any undue program risks associated with the planned socio-economic commitment goals (i.e., 25% total – 15% ay small business and 10% service disabled veteran owned small business). However, we would advise against anything other than full and open or increasing the small requirement above that stated in the virtual industry day slides. We have seen examples where larger set-asides or other than full and open have introduced unnecessary program risk in contract execution
The Government appreciates your input
Contract Type Given the scope of planned work and the potential for shifts in requirements over the life of the planned J10 A&AS contract, concur with a Cost Plus Fixed Fee Level of Effort (CP-LOE) acquisition strategy. An alternative would include incentive fees that include:
a. Adequately define performance-based contract requirements in clear, specific, and objective terms with measurable outcomes. Include essential metrics relating to cost-per-unit usage.
b. Establish the cost-reimbursable term-form contract in which the contractor is required to provide a specified level of effort for a stated period of time.
c. Establish an effective means to measure operational costs and ensure that the level of operational funding was tied to the actual workload required to sustain the effort.
The Government appreciates the input
