2. Nature and/or description of the action being approved.

a. Acquisition purpose and objectives. The Division of Physical Security Management (DPSM) manages and supports the Physical Access Control System (PACS) at the National Institutes of Health (NIH) Bethesda Campus, local leased facilities, Fort Detrick Integrated Research Facility (IRF), Bayview Research Center (BRC), and Rocky Mountain Laboratories (RML).

b. Project background. Currently, the NIH is upgrading their end of life (EOL) PACS throughout the NIH enclave properties, including the Bethesda Main Campus (BMC), Rockville, Twin Brook, Baltimore, Poolesville, (Fort Detrick Integrated Research Facilities – FD IRF) Frederick MD, and (Rocky Mountain Laboratories – RML) Hamilton, MT.

The Schneider Electric Access Expert (AE) is an External Cloud Hosted Commercial-off-the-Shelf (COTS) software application provisioned by Schneider Electric. DPSM procured this software application and is currently in the process of implementing the new system.

This PACS-AE application operates within the Amazon Web Services (AWS) GovCloud High Assurance external hosting environment, which is managed and maintained by the Office of Innovation and Information Technology (OIIT) organization. There is secure network connectivity established between FACnet (Campus) and AWS GovCloud external hosting environment through CIT B12 AWS Direct connect primary infrastructure and Sterling location as redundant infrastructure.

This acquisition is conducted under the authority of 41 United States Code (U.S.C.) 253(c) (1) as set forth in Federal Acquisition Regulation (FAR) 6.302-(1).

Schnieder Electric is the manufacturer of the Access Expert (AE) application and hardware used for the NIH Physical Access Control System (PACS) upgrade.

The AX-MP4502 controllers and AX-MR50 door controllers are specific devices used with the AE application.

The agency’s access control system is based on the Schneider Electric Access Expert (AE) platform, which requires the use of AX-MP4502 Intelligent Controllers and AX-MR50-S3 Reader Interface Modules for system expansion and maintenance. These modules are hardware components compatible with the current AE system and are specifically designed, branded, and supported for use with AE. Use of alternative hardware would result in substantial duplication of cost, unacceptable delays, and loss of vendor support and warranty. Therefore, only the

specified modules from Schneider Electric or its authorized distributors will satisfy the agency’s requirements. Authorized distributors are very limited in the Rockville, Maryland area

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

The offer will be solicited following FAR 5.102 (a) (6), and being brand-name offer see especially FAR 13.501 (a)(2).

7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.

An independent Government Estimate has been developed (IGE) based on the history of the previous contract, current market conditions and program expectations. However, to ensure that the price will be fair and reasonable, the data from the IGE will be compared with the proposal received from the offeror.

An award will be made only if during negotiations; it is shown that the anticipated price to the government will be fair and reasonable.

8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.

The Schneider Electric Access Expert system and hardware is proprietary. The AccessXpert MP-4502Intelligent Controllers and AX-MR50-S3 AccessXpert Reader Interface Modules are specifically used by the PACS AE system.

9. Any other facts supporting the use of other than full and open competition.

It is NIH’s policy to promote the use of competitive procedures whenever and wherever possible. To remove or overcome barriers to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the government’s requirement.
