JUSTIFICATION AND APPROVAL FOR OTHER THAN
FULL AND OPEN COMPETITION
1. Nature and/or description of the action being approved:
Purchase of three (3) mobile X-Ray trucks, two (2) mobile Computerized Tomography (CT) scanner trailers, two (2) tractor trailer heads for the CT scanner trailers, installed equipment in the medical units, and in-country training for the intended operators. All purchased items and services will be donated to the Egyptian Armament Authority (EAA) as assistance for COVID response. The total value of the procurement is approximately $8.3MM.
2. A description of the supplies or services required to meet the agency's needs:
In February of 2019, the EAA sent a Letter of Request (LOR) LOR 19/CU/27001 to the Office of Military Cooperation (OMC) to purchase mobile medical units, including installed equipment and training. Matthews Specialty Vehicles (MSV) of North Carolina along with their in-country agent, Wassel Corporation, were requested by the Government of Egypt as the vendor for this requirement.
In June of 2020 Secretary Pompeo approved repurposing up to $10 million in already obligat the COVID-19 pandemic. Specifically, NEA A/S Schenker authorized this support to include the procurement of Mobile COVID-19 Testing Units, Mobile Laboratories, installed medical equipment, and training for Egypt.
The first stage of procurement, executed in early 2021, was the small-scale purchase of a testing/vaccination van and a mobile laboratory. This initial $1.3MM purchase from MSV, also using a J&A, was intended to test the efficacy of the process using reclaimed FMF funding. After successful purchase and delivery of these vehicles to Egypt, the second-stage is now ready to proceed.
3. An identification of the regulation permitting other than full and open competition:
41 USC 253(c) (1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
4. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
MSV is the only vendor capable of meeting the detailed requirements set by the Egyptian Military for this procurement. MSV has almost 30 years of manufacturing purpose-built specialty medical vehicles for the domestic and overseas markets.
As the provider for the vehicles required by the LOR, MSV is already familiar with Egyptian Military vehicle requirements (fuel type, suspension, etc). As compatibility with existing medical equipment is a key requirement, MSV is uniquely qualified as they have an in-depth knowledge of the equipment in use as they have already worked with the Egyptian military to identify and source compatible medical equipment for the LOR.
Additionally, their in-country agent, Wassel Corporation, provides MSV the ability to provide real-time issue resolution, further reducing the potential for unnecessary delay. The Wassel Corporation has extensive history working with the Egyptian Armed Forces and has the contacts required to quickly and effectively resolve problems should they arise.
5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (c.g., blanket waiver provided in
DOSAR 605.202-70):
No other solicitations were contemplated due to unique vehicle and equipment requirements provided by the EAA.
6. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
As the vehicles are custom built for the specific use-case(s) defined by the EAA, there is no standard price for comparison. However, a majority of the price for the X-Ray trucks and CT trailers is the cost of large pieces of complex medical equipment (X-Ray Machines and CT Scanners). These items will be procured by MSV directly from the manufacturer at standard prices. MSV has a long history of work with local, State, and Federal government agencies providing purpose-built medical vehicles at acceptable prices. All of these factors combine to provide assurance that the quotation provided is fair and reasonable to the USG.
7. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
No market survey was conducted due to the unique vehicle and equipment compatibility requirements provided by the EAA
8. Any other facts supporting the use of other than full and open competition:
N/A.
9. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.
No other sources have expressed interest in this acquisition.
10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
This J&A for other than full and open competition shall be published on FedBizOpps in accordance with FAR section 6.305 within 14 days after contract award.
