Section A: General Contract Information
Contracting Activity: Elastec, 1309 West Main Street, Carmi, Illinois, 62821. USA
Project/Program Name: MaxiMax Boom Reel System
Purchase Request/Identification Number: 0060100 / 0540640 / 0REELBO145D / 0POWEYA506 / 4SLINLI010
Estimated Contract Cost (including Options): $66,290.30
Section B: Description of the Supplies/Services Required
The MaxiMax range of boom reels are ideal for rapid deployment and oil containment with a low storage volume that allows them to be stored on pallets or wound on reels. This compact nature makes this particular range of boom reels ideal and especially useful in marine areas, where deployment in ports and harbors depends on maneuverability around vessels and protecting resources. Quick response is another benefit of the MaxiMax range. The fence booms feature closed cell foam buoyancy panels, vertical stiffeners, galvanized chain ballast, stainless steel top tension cable, handles, anchor points, and are ideal for static or low current applications.
MaxiMax is a range of boom reels manufactured by Elastec, Inc. which has been manufacturing quality floating boom and barrier products since 1967.
Section C: Justification for Soliciting from a Single Source or Brand Name
Elastec, Inc. is the sole vendor/manufacturer of the MaxiMax range of boom reels, which Lajes Field relies on for safe and efficient response to marine spills. The spill team at Lajes currently has two MaxiMax reels, which have crucial parts damaged.
This requirement is for items to replace those parts that are damaged, and need to be of the same brand name to ensure proper integration and functionality with the current reel system. An additional reel of this range is also required, to increase the spill team's ability to respond to potential incidents. A sole source solicitation based on brand name is justified in this case, as the parts need to be manufactured to function effectively with the same range currently utilized by Lajes Field. Elastec, Inc. is the only vendor who possesses this capability.
Section D: Efforts to Obtain Competition
Thorough market research was conducted by the CA which determined that there is adequate reason to expect other than full and open competition for the items required. Initially, a Sources Sought was posted on Beta.SAM.gov to allow maximum visibility. No interested vendors responded with interest or claims of technical capability of providing the items required.
Secondary market research was then conducted through general Internet searches and the use of government resources such as Beta.SAM.gov, SAM.gov, FPDS-NG ezSearch, and FAPIIS.gov. This research revealed that there is a valid GSA contract (47QSWA19D0007) with the vendor, which expires in 2023. The vendor is currently active in the SAM database, and has no negative data reports through FAPPIIS. A combined synopsis/solicitation as an RFQ was published on Beta.SAM by 65CONF in 2005, with reference ID F2N333S5138A100. Items by Elastec, Inc., the manufacturer of the MaxiMax range were referenced as the requirements for this solicitation, and there are many contracts awarded by the Government to Elastec, Inc. as listed on FPDS- NG. Additionally, acquisitions of like items were researched to attempt to identify further vendors that sell this range of reels and/or its parts, as needed by the customer. This revealed that Elastec, Inc. is in fact the only vendor and manufacturer of this brand. No other companies or manufacturers were identified as capable of meeting the requirements of this acquisition.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
In order to mitigate future limitations on competition, the Government should be aware and contemplate that when purchasing supplies or products with such specific manufactured characteristics, all future purchases related to those supplies or products have the potential to result in being locked into buying from the same brand name or sole source.
