J&A No. ML-20-32 13 April 2020
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. The contracting activity is Naval Facilities Engineering Command, Mid-
Atlantic, Public Works Department Maine, Portsmouth Naval Shipyard, Kittery, Maine. The
Contracting Officer is the Facilities Engineering and Acquisition Division of the Public Works
Department, Portsmouth Naval Shipyard, Kittery, Maine.
2. Description of the Action Being Approved. Award of a 12-Month Indefinite Delivery, Indefinite Quantity contract utilizing Blanket Task Orders on a sole source basis with Insurcomm Inc. for COVID19 Cleaning Services at Portsmouth Naval Shipyard, Kittery, Maine. This contract is necessary to ensure proper cleaning of identified spaces affected by the spread of COVID19. Immediate award of the contract is necessary to begin cleaning services as soon as possible to respond effectively to an increasing number of incidents/cases.
3. Description of Supplies/Services. The Contractor shall furnish all labor, management, supervision, tools, materials, supplies and equipment required to perform sanitization services related to COVID19. The Novel Coronavirus, COVID-19, pandemic began to spread in the United States in January 2020. COVID-19 is a respiratory disease that can spread from person to person and is highly infectious. A requirement for cleaning and disinfecting areas where person(s) suspected of or with confirmed COVID-19 have visited or stayed in the cases of on shipyard housing is necessary. Due to the highly infectious nature of this virus, it has been determined that CDC specific cleaning services would be appropriate to handle this hazardous material. The estimated value of this action is $700,000.00. Funding in the amount of $85,000.00
FY20 O&MN is available for immediate use through the issuance of blanket task orders. The estimated period of performance of the basic IDIQ contract is from 13 April 2020 through 12
April 2021.
4. Statutory Authority Permitting Other Than Full and Open Competition. Pursuant to FAR 6.302-1, this acquisition will be acquired under the authority of 10 U.S.C. 2304(C)(2), the agency’s need for these services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to FAR 5.22(a)(2).
5. Rationale Justifying Use of Cited Statutory Authority: The use of the authority cited in Section
4 is deemed appropriate due to the unusual and compelling need for COVID19 Sanitization
Services at the Portsmouth Naval Shipyard. Immediate ability to perform sanitization services is essential; unsanitized spaces where an identified case of COVID19 is/was present could pose a health hazard and failure to clean/sanitize these spaces would result in unsanitary and unhealthy conditions. Failure to perform sanitization services will adversely affect both military and civilian personnel and threaten continuity of operations at the facility.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. The
Government researched the North American Industry Classification System (NAICS), and the
Small Business Administration’s Dynamic Search function for the following NAICS code(s):
NAICS CODE 562910: Remediation Services- This industry comprises establishments primarily engaged in one or more of the following: (1) remediation and cleanup of contaminated buildings, mine sites, soil, or ground water; (2) integrated mine reclamation activities, including demolition, soil remediation, waste water treatment, hazardous material removal, contouring land, and revegetation; and (3) asbestos, lead paint, and other toxic material abatement.
The Government approach is to research the SBA Small Business Dynamic Search (SDBS) for potential vendors under NAICS Code 562910. The search results yielded 61 potential small business vendors including Insurcomm Inc. who is being identified as the sole source.
Several of the vendors presented on the SDBS results have worked onboard Portsmouth Naval
Shipyard in Kittery, Maine. If time permitted, a full and open competition set aside for small business would be appropriate and it is expected that there would be adequate competition;
however, due to the urgent and compelling nature of this requirement, a sole source award to
Insurcomm Inc, a small business, is appropriate for the urgency of this procurement.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition. The Government expects to develop a performance specification that will support competition for future acquisitions of the same or similar services.
