FAR 8.405-6 Limited Sources Justification and Approval National Archives and Records Administration 8601 Adelphi Road College Park, MD 20740-6001

Motion Picture Color Film Processing

Technical Requirements Certification:

I hereby certify that this limited source justification for an item peculiar to one manufacturer is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully complete this requirement. I further certify this request is not the result of a desire to expand funds while those funds are still available.

I. INDENTICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “LIMITED SOURCE JUSTIFICATION.”

See Page 1

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

The National Archives and Records Administration (NARA) request approval of a limited sole source provider (Colorlab Corporation) to procure 16mm and 35mm color and /or black and white film processing film.

III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE).

NARA’s Motion Picture Preservation Lab is responsible for preserving and reformatting the motion picture holdings of the National Archives. This includes assessing the collections, performing repairs, and using a variety of equipment to create new prints and negatives to sustain content. The motion picture collection holdings contain thousands of 16mm and 35mm reels that are in need of photochemical preservation. Even though the Motion Picture Preservation lab is capable of printing new copies of the reels in house with NARA’s own equipment, they are unable to process (i.e. develop) said reels in house. In the past NARA has worked with Colorlab to have these reels processed on an ad-hoc basis under previous contracts such as NAMA-10-F-0060, NAMA-12-F-0008, and NAMA-17-F-0001. Colorlab Corporation is the only approved NARA vendor capable of processing color film.

The total estimated value is $.00 Period of Performance is from 9/28/21 – 9/27/22 for the base year with four option years.

IV. IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR SUBPART 8.405-6(b)) AND, IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE.

41 U.S.C. 251, et seq. – Title III of the Federal Property and Administrative Services Act of 1949 and Title 40 U.S.C. 501 – Services for Executive Agencies as implemented by FAR Subpart 8.405-6(a)(2) “ The item is peculiar to one manufacturer.”

V. A DETERMINATION BY THE ORDERING ACTIVITY CONTRACTING OFFICER THAT THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR SUBPART 8.404(d).

Colorlab’s pricing offered under its GSA Schedule are listed as fixed price for performance of the specific task. GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contract to be fair and reasonable. Therefore, ordering activities are not required to make separate determination of fair and reasonable pricing except for a price evaluation as required by FAR Subpart 8.405-2(d).

VI. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG SCHEDULED HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED.

Market Research shows that local companies provide motion picture reformatting services ranging from traditional photochemical work to reformatting doe broadcast purposes; however, Colorlab is the only local vendor who is capable of processing color and black and white films.

VII. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION.

NARA’s Motion Picture Preservation Lab has utilized Colorlab Corporation to process color film at its location in College Park, MD since 1994.

Colorlab Corp. is the current contract holder and the only vendor that meets NARA’s requirements at this time. Other vendors may have the ability to process some black and white film, but no vendor, to date, is able to develop color film or has been able to fulfill NARA’s pickup and delivery requirements.

It is important that the work be done locally to 1) avoid risk of damage to the records, 2) avoid extravagant shipping costs, and 3) so that NARA may maintain the 14 day turn-around time for the Motion Picture Film, Sound and Video Recording archival unit to fulfill requests from patrons. This 14-day turnaround time is the standard amount of time it takes to pull the records, allow us ample time to do preservation if needed, to print the new copy and to send and receive the reel back from Colorlab. Therefore, that NARA may do quality control before handing the record back to the Motion Picture Film, Sound and Video Recording archival unit.

VIII. A STATEMENT OF THE ACTIONS, IF ANY THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT PRECLUDE THE AGENCY FROM MEETING THE REQUIREMENTS OF FAR SUBPART 8.405-1 AND FAR SUBPART 8.405-2 BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE.

This procurement is except of any action or barriers that lead to the restricted consideration in accordance to FAR Subpart 8.405-6(a)(1)(i)(B) where only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. As technology changes, NARA will monitor the marketplace to seek, alternate solutions that either advance the capabilities of the status quorum achieve better overall value, and review its option for future consideration from both a budget and compatibility perspective.

IX. THE ORDERING ACTIVITIES CONTRACTING OFFICER’S CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF.

See page 1.

X. EVIDENCE THAT ANY SUPPORTING DATA THAT IS THE RESPONSIBIITY OF TECHNICAL OR REQUIREMENTS PERSONNEL (E.G., VERIFYING THE GOVERNMENT’S MINIMUM NEEDS OR REQUIREMENTS OR OTHER RATIONALE FOR LIMITED SOURCES) AND WHICH FORM A BASIS FOR THE JUSTIFICATION HAVE BEEN CERTIFIED AS COMPLETE AND ACCURATE BY THE TECHNICAL REQUIREMENTS PERSONNEL.
