DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING COMMAND NORTHWEST
1101 TAUTOG CIRCLE
SILVERDALE, WASHINGTON 98315-1101
J&A No. 20-25JA
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The Agency is the Department of Navy. The contracting activity is the Naval Facilities Engineering Command Northwest (NAVFAC Northwest), Silverdale, Washington.
2. Description of the Action Being Approved.
This justification requests approval to extend the contract completion date of the N44255-15-D- 0011, Civil Structural Engineering Services contract for an additional six months beginning 17 September 2020. The contract was awarded to WSP USA (Berger Abam) on 17 September 2015 for a period of one year and 4 option periods. Option period four expires on 16 September 2020.
This contract provides the Navy mission essential civil structural engineering services for NAVFAC Northwest and its Area of Responsibility.
A six- month bridge contract is requested to ensure there is no gap in NAVFAC Northwest’s civil structural A-E services. There is a continuing need for these services, but the follow-on contract will not be awarded prior to 17 September 2020 when the current contract expires.
3. Description of Supplies/Services.
The work to be performed provides primarily for the preparation of design-bid-build and design-build request for proposals including construction plans, specifications and engineering services for contracts to accomplish renovation projects or construction of new facilities
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(d)(1)(B), as implemented by FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1 permits contracting without providing for full and open competition in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The current contract, N44255-15-D-0011 Civil Structural Engineering Services was competitively procured via Selection of Architectural-Engineering Services (formerly Brooks Act) procedures for an anticipated $20 Million with a base and four option periods. WSP USA was selected as the most highly qualified firm. A Justification and Approval was approved for
Page 2 of 4 J&A No. 20-25JA an additional $4M to support NAVFAC Southwest projects in January 2020, raising capacity from $20M to $24M.
There are no duplicative costs as a competitive unrestricted Selection of A-E Services request for A-E qualifications.is underway for the follow-on contract with an expected award date of 30 December 2020 however three additional months are requested in the event of contract award delay. The estimate was arrived based on the follow-on contract’s current project milestones and projected award date.
The delay is unacceptable in fulfilling agency mission requirements and timely execution of the construction by the year of authorization. Anticipated delays include a minimum three month delay associated with finalizing the procurement of the follow-on A-E contract.
The Navy has multiple current Fiscal Year (FY) 20 funded requirements critical to supporting the warfighter’s mission and awards must be executed prior to 30 September 2020. Failure to extend the current contract will have an unacceptable impact on supporting the Navy’s mission.
Current requirements are listed below:
Project Estimate
Repair Railroad Culverts Phase 2 $850,000 Wheeler Mountain Ground Movement Study Phase 2 $471,662 Repair Storm water Outfall 15 $385,704 Modify Bldg for SCEPS Shop, B894 NUWC, Keyport $304,200
Correct Seaplane Fire Flow Deficiencies @ Fuel Pie $250,000 Replace Steam Line B100 and Install Boilers $150,000 Replace Airfield Lighting Regulators $250,000 Extend Bldg and Add MonoRail Chain Hoist, B7059, Bangor $60,000
PCAS - Repair Railroad Culverts Phase 2 $165,000 Various NAVFAC SW Projects $3,148,715
Total planned amount $5,663,619
Approval of this J&A is for an increase in time only. The contract’s available capacity of approximately $728K (includes the planned project estimates) is sufficient to meet the Navy’s known requirements and any emergent Civil Structural Engineering Services should they arise prior to award of the follow-on contract.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
No other sources have expressed interest in these actions. These actions are not synopsized as they are fulfilled by issuance of task orders under an indefinite-delivery indefinite-quantity contract. In accordance with (FAR) 6.305, the approved Justification and Approval (J&A) will be made publicly available, and posted on the Government’s Point of Entry, Beta.SAM website, Contract Opportunities, within 30 days after award of the contract modifications.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government for the services covered by this J&A will be fair and reasonable based on pre-negotiated rates in the current contract under option year four.
8. Actions to Remove Barriers to Future Competition.
The follow-on contract, N44255-19-R-6106 Civil Structural Architect-Engineering (A-E) Services, has been publicly solicited. Competition requirements were met through the issuance of an unrestricted Selection of A-E Services (formerly Brooks Act) request for A-E qualifications.
A-E qualifications have been received and the procurement is currently in slate-selection. The planned award date is 30 December 2020 however three additional months are requested in the event of contract award delay.
