About this file

This is an Amended Justification Review Document for a FAR Part 12 acquisition of commercial products and services. The Contracting Activity, Medical Readiness Contracting Office West (MRCO-W), requests approval to award a new noncompetitive five-year firm-fixed-price contract for preventative maintenance and repair services for machines located at Brooke Army Medical Center (BAMC), Fort Sam Houston, Texas. The requirement is funded through Defense Health Program (DHP) appropriations. The contract will include a base year (15 June 2026 – 14 June 2027) and four one-year option periods (through 14 June 2031), with an additional extension period under FAR 52.217-8 (15 June 2031 – 14 December 2031). The estimated total contract value spans multiple million dollars across the full performance period.

The justification for sole-source procurement is based on Title 41 U.S.C. §1901 as implemented in RFO FAR 12.102(b), establishing that only one responsible source exists capable of satisfying the requirement. BAMC currently operates 231 machines that provide quick access to surgical uniforms while maintaining infection prevention compliance. The original warranty has expired, necessitating a preventive maintenance contract. The original equipment manufacturer (OEM) is the exclusive authorized provider, having provided a Sole Distributor Letter confirming sole-source status for the equipment and maintenance program. Proprietary firmware software updates developed by the OEM further restrict competition. Market research efforts included a Sources Sought Notice posted 23 September 2025 (closing 23 October 2025) and a Notice of Intent to Sole Source (5 May 2026 – 12 May 2026), neither of which identified alternative capable sources. The alternative of replacing all 231 machines is deemed cost-prohibitive. Without the maintenance contract, the web-connected machines would become non-operational, potentially resulting in canceled surgeries and procedures. The contracting officer has determined the anticipated price to be fair and reasonable based on comparison with previous purchases, and the redacted justification will be posted to the Government Point of Entry within 14 days of contract award.

5. Authority Cited: Title 41 United States Code (U.S.C.) §1901 as implemented in RFO FAR 12.102(b ), restricting competition for acquisitions valued over the Simplified Acquisition Threshold.

6. Reason for Authority Cited: In accordance with RFO FAR 12.102(b) there is only one responsible source, and no other supplies or services wi ll satisfy the specific agency requirements.

CUI/ /SP-PROCURE/ /FEDCON

a. Background: There are (231)- machines currently in place at BAMC, which allow quick access to surgical uniforms for the doctors, surgeons, and medical staff for surgical and routine treatment to patients in an immediate time frame while maintaining infection prevention compliance for safe storage of scrubs. The Government currently owns the - machines, however, the initial warranty has expired therefore, a preventive maintenance and repair contract must be establ ished to reinstate and extend the equipment's coverage.

b. Alternatives: There are no other vendors that are authorized to provide preventative maintenance services on the equipment. The only alternative would be that BAMC replace all machines that are currently in place at the hospital. This alternative is cost-prohibitive and is not an appropriate use of government funds.

c. Impact if not approved: The- machines require web-based connectivity to function, so if the requirement is not approved, BAMC's (231 ) - machines will no longer function resu lting in non-operational equipment. This would result in an inefficient and ineffective method of providing surg ical uniforms for the staff.

This could result in canceled surgeries and procedures. Additionally, any malfunctioning machines would not be repaired without a maintenance contract in place.

7. Efforts to Obtain Competition: A Sources Sought Notice was posted to Government Point of Entry (GPE) at www.SAM.gov on 23 September 2025 with a closing date of 23 October 2025. The Sources Sought Notice failed to identify any additional sources capable of satisfying the subject requirement. There is no reason to believe posting an updated Sources Sought in 2026 will yield different results. The Contracting Officer has published the notices required by FAR 5.201 and any bids or proposals received shall be considered . A Notice of Intent to Sole Source was also posted to the GPE from 5 May 2026 to 12 May 2026 but received no responses from vendors capable of satisfying th is requirement.

has provided a Sole Distributor Letter stating that . , is the sole source distributor of- equipment, including the maintenance program. Based on extensive market research and the results of the notices published to the GPE, competition is not anticipated for th is requirement.

b. Subcontracting competition: Due to the nature of this requirement, subcontracting opportunities are not available.

CUI/ /SP-PROCURE/ /FEDCON

8. Actions to Increase Competition: This action is to award a long-term contract for maintenance for all - machines located within BAMC. Under the previous Justification and Approval (Control No. ) the paragraph, "Actions to Increase Competition" stated:

All actions stated above were accomplished during the market research phase of the FY25 new requirement identified no additional sources capable of satisfying BAMC's requirement. The Government will continue to assess the market for new entrants. If, in the future, other compatible products become available, market research will be performed to consider other sources that meet or exceed the current requirement.

Additionally, an evaluation of the market will be conducted prior to any renewal related to th is requirement. Pricing, availability, and any alternative solutions will be the focus of that research. The contract file will be properly documented with any find ings. In accordance with FAR 6.305(a), a copy of the redacted J&A will be posted to the GPE within 14 days of contract award.

9. Market Research: In accordance with FAR Part 10, market research was completed by both the requiring activity and contracting office using the following techniques:

• Thorough review of recent procurement history including market research find ings from previous requirements.

• Sought feedback via formal requests for information as well as a Sources Sought Notice and a Notice of Intent to Sole Source, which were both publicized on www.SAM.gov. The sources sought notice was posted on 23 September 2025 and closed on 23 October 2025. The only vendor that responded was ■, who is the authorized manufacturer.

• Queried government-wide databases that provide relevant information on similar acquisitions.

• Conducted internet searches.

• Reviewed Federal Supply Schedule contracts and other government contracts.

10. Interested Sources: To date, no other capable sources have written to express an interest in th is requirement. In accordance with FAR 5.201, all notices have and shall be published to the GPE, and any bids or proposals received shall be considered .
