JUSTIFICATION AND APPROVAL

FOR LIMITED SOURCES UNDER FAR 8.405-6

1. The Department of State, Office of Acquisition Management is conducting this modification for a scope increase for additional support for the processing of industry request for export licenses on behalf of Bureau of International Security and Nonproliferation. The estimated cost is $18,000,000 for the remaining 2 option years.

2. Nature and/or description of the action being approved.

The required action is for a modification to increase the ceiling of SAQMMA10F3116.

3. A description of the supplies or services required to meet the Department's needs.

The increase ceiling will support the additional labor required by the Presidential Export Control Reform initiatives affecting the processing of export licenses.

4. An identification of the statutory authority permitting other than full and open competition.

This limited sources justification utilizes FAR 8.405-6 (a) (1) (i) (C); in the interest of economy and efficiency, the new work is a logical follow-on to the original order.

SAQMMA10F3116 was competed in accordance with GSA ordering procedures.

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

The nature of this action warrants acquiring additional contract ceiling due to a recently mandated U.S. Government review of its export control system and regulations. The review assessed the feasibility of using a single interagency application on a common government-wide network for all export control and licensing activities performed by each U.S. agency involved in the process. This resulted in a multi-year effort that has an enormous impact on our support to the Department’s Defense Trade Application System (DTAS), which currently processes all U.S. export license requests, and forms a large portion of our software development and O&M requirements. Pending changes to U.S. export policy and related business processes requires additional resources and expertise to implement new requirements that were not considered previously. Meeting the requirements of the new policy makes competing this new work impractical at this time.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

The original requirement was competed on GSA e-Buy. In accordance with FAR 8.404 (a) ... , "Ordering activities shall not seek competition outside of the Federal Supply Schedules or synopsize the requirement"

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The current contract prices were determined to be fair and reasonable based on adequate price competition. Prices for the increase in scope will be consistent with prices already established on the order.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

The contracting officer will conduct an assessment to determine if this order is the most advantageous of fulfilling the department’s need when considering exercising the next option.

9. Any other facts supporting the use of other than full and open competition.

None.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

No sources have expressed an interest in writing in this acquisition at this time.

11.A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supp lies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with

FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.)

This J&A will be published on FedBizOpps in accordance with FAR Section 8.406-6 (a) (2) within 14 calendar days of award.
