SECTION 102 – DEFINITIONS

1.1 Definitions

Clearing Limits – The limits of clearing as designated on the ground or on the drawings.

Conservation Practices – Required conservation practices (CP) allowance represents expenses incurred by the Association in performing on-the-ground range improvements, or other practices designed to enhance the productivity of the National Grasslands. Required conservation practices are practices approved in the allotment AMP. Title to any range improvements constructed on Federal land will remain with the U.S. Government.

Contracting Officer – The person executing this contract on behalf of the Government or Grazing Association, and includes a duly appointed successor.

Contractor – The individual partnership, joint venture, or corporation undertaking the execution of the work under the terms of the contract and acting directly or through their agent, employees, or subcontractors.

Contract Time – Number of calendar days allowed for completion of the contract work.

Drawings – The documents, including plan and profile sheets, cross sections, diagrams, layouts, schematics, descriptive literature, and similar materials showing details for construction of a facility.

Engineer – The Contracting Officer’s Representative (COR) for Public Works Contracts, or Forest Service Representative for CP Contracts, responsible for onsite administration of the contract within the limits of specific delegation.

Equipment – All machinery and equipment, together with the necessary supplies for upkeep and maintenance, as well as tools and apparatus necessary for the proper construction and acceptable completion of the work.

Forest Service – The United States of America, acting through the Forest Service, United States Department of Agriculture.

Grazing Association – A member-owned, member-operated, and member-managed nonprofit association of family farmers and ranchers organized to acquire and develop grazing land to provide seasonal grazing for livestock belonging to its members, using a combination of private and Federally-owned land.

Gage – The term “gage” when used in connection with the measurement of plates will mean the U.S. Standard Gage, except when reference is made to the measurement of metal sheet used in the manufacture of corrugated metal, pipe, metal plate culverts and arches, and metal cribbing, then the term means the “gage” or “thickness” specified in AASHTO M 36, M 167, M 196, and M 219, as applicable.

Range Betterment Fund (RBF) – The fund established by title IV, section 401 (b) (1), of the Federal Land Policy and Management Act of 1976. This consists of 50 percent of all money received by the United States as fees for grazing livestock on the National Forests in the 16 contiguous western states.

Government Land – National Forest System lands and other lands controlled or administered by the Forest Service.

Laboratory – A testing laboratory of the Government or any other testing laboratory approved by the Engineer.

Materials – Any substance specified for use in the construction of the project and its appurtenances.

Measurement – Method of determining and expressing the quantities of work or materials.

Nominal Dimensions or Weights – The numerical values shown on the drawings or in the specifications as measurements of materials to be used in the construction.

Profile Grade – The trace of a vertical plane, as shown on the drawings, intersecting the top surface at the centerline of the proposed facility construction.

Right-of-Way – A general term denoting: (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands) or (2) land, appurtenances thereto, or interest therein, usually in a strip, acquired for public or private passageway.

Schedule of Items – A schedule in the contract that contains a listing and description of construction items, quantities, units of measure, methods of measurement, unit price, and amount.

Specifications – A general term applied to all written directions and requirements pertaining to the performance of the work.

Standard Specifications – The specifications in this package.

Unit of Measurement – The unit and fractions of units shown in the Schedule of Items.

Station – One hundred linear feet.

Unit – A single quantity regarded as a whole in calculation; for example, 1,000 sq. ft.

SECTION 103 – INTENT OF CONTRACT

1.1 Intent of Contract.

Item 1 Range Pipeline - The intent of the contract is to provide for the complete construction of a range water system that includes placing a 2” HDPE water lines above ground, drains, air release valves, and a stock tank. The waterline and valves will require staking to hold in placed with wooden stakes. The tank location shall be leveled and constructed with 6” compacted depth of scoria or aggregate extending 10’ outside tank perimeter. Aggregate is Government furnished and is available in a stockpile near the site. The contractor shall be required o furnish equipment to load, haul and place aggregate.

Item 2 Range Fence– The intent of the contract is to provide for the complete construction of a new barb wire fence complete with steel line posts, H braces, corner braces, and steel panel gates with object markers. The work shall also include removing a gate and cattle guard with bases to a new location as staked on the ground. The contractor shall place 40 yards of aggregate on the new approaches to the cattle guard to provide a smooth transition. Aggregate is Government furnished and is available in a stockpile near the site. The contractor shall be required to furnish equipment to move the cattle guard and concrete bases and to load, haul and place the aggregate. The cattle guard bases are in very heavy and will require special equipment to lift and transport them.

Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tool, transportation, and supplies, and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract.

SECTION 106 – MEASUREMENT AND PAYMENT

1.1 Measurement and payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered incidental to and included in the payment of the pay items in the Schedule of Items.

When more than one class, size, or thickness is specified in the Schedule of Items for any pay item, alphabetical suffixes will be added to the item number to differentiate between the items to be bid on.

1.2 Methods of Measurement. The following methods of measurement are used to determine contract quantities for payment.

For individual construction items, longitudinal and lateral measurements for area computations will be made horizontally, or corrected to horizontal measurement, unless otherwise specified. Measurements for seeding, mulching, sprigging, and sodding will be along slope lines.

1.3 Units of Measurement. Payment will be by units defined and determined according to U.S. Standard measure, and by the following:

A. Lineal Foot - LF

B. Lump-Sum Quantity - LS

C. Each – EA

D. Cubic Yard - CY

1.4 Payment. One of the following methods of measurement for determining final payment is designated on the Schedule of Items for each pay item:

A. Contract Quantities (CQ). These quantities denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertising the project. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the contract. Changes in the number of units of the originally contemplated work will not be made unless authorized under one or more of the following conditions: As a result of changes authorized by the Contracting Officer in the originally contemplated work. Minor changes to adjust lineal footage etc., will not be considered changes in quantities. As a result of the Contracting Officer determining that errors exist in the original design data used to determine designed quantities that cause a pay item to change by 10 percent or more.

1. As a result of the Contractor submitting to the Contracting Officer a written request showing evidence of errors in the original design data used to determine design quantities that cause a pay item total to change by 10 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is believed to be in error. Final payment will be made for the designed quantities at the unit price shown in the Schedule of Items, subject to the Variation in Quantities clause.

B. Staked Quantities (SQ). These quantities are determined from staked measurements prior to construction.

C. Actual Quantities (AQ). These quantities are determined from measurements of completed work.

D. Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job. They will not be measured.

SECTION 151- MOBILIZATION

PART 1 – GENERAL

Description

1.01 This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site; obtaining of permits, insurance, and bonds. This work also includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands, according to the requirements within.

PART 2 – EXECUTION

Construction Requirements

2.01 Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment. Only equipment inspected by the Forest Service will be allowed to operate within the project area. All subsequent move-ins of equipment to the project area will be treated in the same manner as the initial move-in. This requirement does not apply to cars, pickup trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.

Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment, components or the need for specialized inspection tools is not required.

Notify the CO in writing at least 72 hours before moving any construction equipment onto the National Forest. Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning.

Use methods of cleaning and locations for cleaning approved by the CO.

For work at a commercial washing facility, use an approved facility.

New infestations of noxious weeds of concern to Forest Service and identified by either Contractor or Forest Service, in the Project Area or on the haul route, will be promptly reported to the other party. Contractor and Forest Service will agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to Forest Service is available at each Forest Service office.

Measurement

2.01 Clean equipment prior to moving onto this project. The initial cleaning will not be included in the measurement for payment. Payment for cleaning will only be made if subsequent cleanings are ordered by the CO. Measurement shall be on an “each” basis, meaning one complete cleaning of all equipment required for this contract. Subsequent cleanings necessitated by the Contractor’s actions but not directed by the CO will not be included in the measurement for payment.

PART 4 – PAYMENT

Payment

4.01 The accepted quantity will be paid at the contract price per unit of measurement for the Section 151 pay item shown in the bid schedule. Payment will be full compensation for the work prescribed in this Section. See Progress payments for mobilization lump sum will be paid as follows:

(a) If applicable, bond premiums will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.

(b) When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.

(c) When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.

(d) Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.

Include all costs associated with the initial cleaning of equipment in the unit bid price for Mobilization. Cleaning for subsequent move-ins will not be paid for unless after a suspension ordered by the CO.

SECTION 170 – CONSTRUCTION STAKING

1.1 Construction Staking. The horizontal layout of the water transmission lines, and related facilities to be installed in this contract, will be staked on-the-ground by the Government. The Contractor will be responsible for maintaining vertical and horizontal control (5 feet either side of C/L) according to the specifications and drawings under this contract. Those stakes or marks which are destroyed through no action of the Contractor shall be replaced by the Forest Service prior to start of construction. The Contractor shall maintain the stakes during the project.

1.2 Waterline Staking – Shall be by the contractor. The contractor shall stake a minimum 2 stakes every 100’including at every valve and fitting. Stakes shall be driven and securely staked.

PART 4 – PAYMENT

4.1 There is no payment for this item.

SECTION 302 – PIPE INSTALLATION AND APPURTINENT EQUIPMENT

WATERLINES

PART 1 – GENRAL

1.1 This section covers the buried waterlines and appurtenances to be installed under this contract. All buried pipe on this project shall be High Density Polyethylene Pipe (HDPE) 4710 SDR9 or approved equal.

1.2 All lines, valves, vents, and drains shall be located as shown on the plans or as staked on the ground.

PART 2 – MATERIAL REQUIREMENTS

2.1 Plastic Pipe and Fittings

A. The plastic pipe shall conform with the latest revision of the appropriate ASTM specification:

B. 1. High Density Pipe(HDPE)-ASTM D-3035

C. All plastic pipe will be marked at regular intervals giving the name or trademark of the manufacturer, commercial standard to which the pipe conforms, the nominal diameter, the type, the pressure rating in PSI of water at 73.4° F. (23° C.) and the seal of approval of the National Sanitation Foundation (NSF).

D. The pipe shall be 2” diameter.

E. The fittings and connections shall be compatible with the pipe being used, and in accordance with the manufacturer’s recommendations. All fittings, except those in CMP risers, shall be brass. All stop and waste valves shall be brass. Minimum 2 keys provided to the COR.

F. Clamps shall be all stainless steel.

2.3 Valves and Valve Boxes

A. Gate Valves: Wedge type gate, non-rising stem, size, and minimum pressure rating as shown on plans and drawings, brass or bronze construction.

B. Check Valves: Swing-check; size and minimum pressure rating as shown on plans; brass or bronze construction.

C. Air Relief Vent Valve: Shall be constructed to release and draw air; brass, cast iron, bronze, or plastic construction.

D. Stop and Waste and Curb Stop Valves: Ball type closure: Minneapolis Pattern; size 2”; brass or bronze construction.

H. Valve Risers and Covers: Cast iron, concrete, size and type shown on the plans.

I. Air and Vacuum Release Valves: Size and minimum pressure ratings as shown on plans; plastic, brass, bronze, or stainless steel construction.

J. Ball Valve: Brass or bronze body. Brass or stainless steel conventional port. Reinforced Teflon or molded Buna-N seats and seals. 90° turn. “C” or gull wing type handle of cadmium or zinc-plated carbon steel. 250 PSI minimum rating.

K. Valve Boxes: 24” Concrete manhole risers with steel lids.

PART 3 - INSTALLATION

3.1 There will be no laying of pipe or pipe fitting work done with plastic pipe when the air temperature is below 40°F.

3.2 The HDPE pipe will be uncoiled to not kink or bind. The pipe shall be placed along the staked location as shown on the plans. The pipe shall be double staked every 100’ with wooden stakes and at every fitting and valve.

3.3 Stop and waste valves shall be placed at low spots, as shown on the plans, along the pipeline for winterization of the line. One Vacuum Air Release valve will be placed as shown on the plans. Valves shall be securely staked and wired in place to the valve box.

3.4 All ends of the HDPE pipe shall be fused by a trained and experienced individual.

4.1 The accepted quantities will be paid at the contract price per unit of measurement of the items listed in the bid schedule.

SECTION 304 – WATERLINE PRESSURE TEST

PART 1 – GENERAL

1.1 All appurtenances installed under this contract shall be pressure tested before backfilling.

PART 2 – EXECUTION

2.1 After the pipe is laid and the joints completed, the newly laid pipe shall be pressure tested as listed below.

A. It shall be hydrostatically (water) tested at the top operating pressure (cut-out pressure) for 2 hours.

B. The system shall be considered acceptable when there is no drop in pressure and no visible leaks at the end of the testing period.

4.1 The accepted quantities will be paid at the contract price per unit of measurement of the items listed in the bid schedule.

SECTION 307 – FIBERGLASS STOCK WATER TANK INSTALLATION

PART 1 – GENERAL

1.1 This section covers all stock water tanks installed on the waterline.

PART 2 – MATERIALS REQUIREMENTS

2.1 Stock water tanks shall be Montana Fiberglass, or approved equal fiberglass tanks.

2.2 Float valves and floats.

A. Float valves shall be, brass or bronze construction. Minimum diameter opening shall be ¾ inch. Float valve shall be designed to operate with a float attached to an arm or lever.

B. Floats shall be plastic, copper, brass, or bronze construction, with a minimum diameter of 6 inches.

C. Posts and Lumber.

1. Posts shall be steel, cedar, juniper, redwood, or pressure treated pine.

2. Lumber shall be new No. 1, S4S, or rough finish, redwood, cedar or pressure treated, or better. Sizes shall 2”x10” minimum or as specified on plans.

2.3 Fittings used to connect the stock tank to the pipeline shall be brass, PVC, nylon, or styrene.

PART 3 – CONSTRUCTION REQUIREMENTS

3.1 Site Preparation

A. Stock tanks shall be installed where staked on the ground and as shown on the plans.

B. An area under the tank and extending 10 feet outside the perimeter of the tank shall be cleared and leveled before the placement of tank. Contractor shall import and compact aggregate to the tank pad area. Aggregate is available near road #31232 in the stockpile. Pad shall be 6” deep, and shall be 10’ outside the perimeter of the tank. The tank shall be set on the center of the aggregate pad area.

3.2 Stock Tank Construction

A. All stock tanks shall be installed level and in accordance with manufacturer’s recommendations.

B. Stock tanks will be set on a firm level base. A scoria or gravel apron will extend 10 feet outside of the tank.

C. All stock tanks shall have a livestock barrier and rodent escape board. Livestock barrier diagram shall be submitted to the CO for approval prior to construction.

D. Water inlets and overflows at stock tanks shall be plumbed through/over the side of the tank in accordance with manufacturer’s recommendations. Plumbing shall be installed to be accessible for maintenance and shall be protected by additional wood bollard posts to keep cattle from damaging plumbing.

E. Floats shall be attached to the level or arm of the float valve with a minimum length of 2 inches of brass or bronze chain.

F. Tank level, as measured from side to side of tank, shall not vary more than 1 inch.

4.1 The accepted quantities will be paid at the contract price per unit of measurement of the items listed in the bid schedule.

SECTION 619 – FENCES, GATES, AND CATTLE GUARDS

PART 1 – GENERAL

1.1 This section covers all fence, gate and cattle guard construction.

PART 2 – MATERIALS REQUIREMENTS

2.1 Steel Line Posts (T posts) – 5’6” steel posts

2.2 Treated Brace Posts – Pressure treated (0.40 CCA) wood posts, 6” diameter by 8’ length

2.3 Barb Wire – 12 ½ gauge, strength 90,000 to 105,000 PSI

2.4 Steel Cross Brace Pipe – 2” New black steel pipe, schedule 40 pipe

2.5 Twist Sticks - #4 or #5 rebar 24” length

2.6 Smooth Wire – 12 ½ gauge, strength 90,000 to 105,000 PSI (for brace wire)

2.7 Fence Nails – 1.5” – 2” galvanized

2.8 Line post clips – galvanized

2.9 Object Markers – Type 3 and Type 3 object markers shall be Hi Vis, Type III retroreflective sheeting on aluminum panels per MUTCD requirements.

2.10 Spikes – 6” minimum length galvanized spikes

PART 3 – CONSTRUCTION REQUIREMENTS

3.1 Steel Line Posts

A. Steel line posts shall be installed no more than 16’ on center along the fence line. Barb wire shall be clipped and crimped on both sides of the T posts. The wire spacing in the diagram is approximate and shall not exceed 42” to the top wire. The Contractor shall adjust the spacing of the posts as needed near H braces and corner braces for a clean and straight fence. Fence shall be attached to the existing fence with an H brace.

B. Braces shall be installed per the drawings. Contractor shall bury 36” depth of the wood post and tamp. 2” steel pipe shall be secured with an interior spike. Smooth wire cross ties and twist sticks shall be tight to prevent movement.

C Barb wire shall be stretched, pulled tight, and properly clipped to steel T posts and attached to wood braces.

E. Panel gates and wire gates shall be hung plumb and level on wood H brace post. The gate shall swing freely and shall be level, not drop or rise through the swing. Type two object markers shall be installed on both sides of the wood posts. Type 3 object markers shall be bolted to both sides of the livestock panel. Type 3 object markers shall be hung to both sides of the wire gate. All object markers shall be per MUTCD requirements and shall be Hi Vis Type III retroreflective sheeting. Wire gates shall have gate closers.

4.1 The accepted quantities will be paid at the contract price per unit of measurement of the items listed in the bid schedule.
