About this file
This document is an Invitation to Negotiate (ITN) Addendum #1 from the School Board of Volusia County, Florida, for a Public Private Partnership (P3) to Build a K-8 School Facility, solicitation number ITN-2024-9000. The project involves constructing a new school with a capacity of 1,353 students (potentially 1,503 student stations) and approximately 161,230 gross square feet. The solicitation opening date is August 15, 2024, at 2:00 P.M. EST, with proposals due by that time. The school will include vocational programs such as Art, Music (choral, band), Stem/Maker Space, Computer Lab, and Orientation and Explorations Lab, with accommodations for 8-10 bus stacking spaces.
The project has a budgetary estimate of $60 million for land and construction, with the district planning to purchase the land outright. The district intends to contract solely with the proposer/developer and will establish a separate budget for computers, curriculum, furniture, fixtures, and equipment. Key requirements include naming all key team members at submission, with potential disqualification if team members cannot fulfill their roles. The district is not currently planning long-term financing for the project and has clarified various technical details about student stations, gross square footage, and submission requirements through this addendum.

The following questions have been received, and the answers to each question are below.
1. Q. What will be the process for procurement of the computers, curriculum, furniture, fixtures, & equipment for this project?
A. The District will establish a separate budget.
2. Q. On page 21 of the ITN under Tab 3, item 3 says the projects listed should be within 5 years, but item 3a says projects should be within 7 years. Can the client please clarify that all past performance projects can be within the last 7 years?
A. Five (5)
3. Q. Does the district plan to actually opt for long term financing on the project?
A. Not at this time.
4. Q. Please confirm that the district intends to purchase the land outright, in line with their usual practice of hedging against future inflation. For clarification, should we focus on presenting purchase options only, rather than alternatives like separating the land from the school via a leaseback arrangement with the developer that could risk putting the equity at stake upon lease expiration?
A. Please focus on purchase options only rather than alternatives. The District will not entertain a leaseback.
5. Q. Please confirm it is the district's intent to contract solely with the proposer/developer as part of the award...not issue individual contracts for services amongst the various team members of the developer's given team (for example - one contract to the developer, one contract to the designer, one contract to the contractor, etc.).
A. It is the District’s intent to contract solely with the proposer/developer. The District is not in favor of issuing separate contracts with the developer’s given team.
6. Q. The ITN mentions a scope of work description for 1,353 student capacity with vocational. Are there specific vocational programs or needs the district has in mind for this school that we should be integrating into the proposed design?
A. Art, Music (choral, band), Stem/Maker Space, Computer Lab, Orientation and Explorations Lab
7. Q. Confirm the total construction cost is $60M or does this represent total project cost?
A. This is only a budgetary estimate for the land and construction.
8. Q. There is a discrepancy between the planned student stations in the ITN and Design Criteria Package. Please advise on the accurate students’ stations and adjusted gross square footage.
A. Please refer to the revised Schedule 1 - Design Criteria Packet dated 8.6.24.
9. Q. Please confirm required bus stacking that needs to be accommodated on-site.
A. 8 – 10
10. Q. As the evaluation process is based upon the strengths and qualifications of the proposed individual companies and roles within a given overall submission, please confirm key team members must be named at the time of the submission and that if any key team members (developer, general contractor/CM, architect) can't fulfill their roles following submission, the result will be a disqualification
THE SCHOOL BOARD OF VOLUSIA COUNTY, FLORIDA
PROCUREMENT DEPARTMENT
200 N. Clara Avenue DeLand, FL 32720 mailto:etkunce@volusia.k12.fl.us and the district will be forced to begin negotiations with the next highest-ranked team?
A. Yes, key team members must be named at the time of the submission. The decision to disqualify before the award of the contract would be made by the Negotiation Team during the negotiation phase.
11. Q. It is stated in the ITN that the firm must provide land (Section 1.3.1.b). Does this mean that any proposals not providing evidence of site identification and due diligence shall make the proposal non-responsive and thereby disqualified?
A. No.
12. Q. The ITN (Section 1.3.1.a) states the scope of work as a school with 1,353 student capacity (equaling 1,503 student stations) and approximately 161,230 GSF. Schedule 1 (Facilities List page 7) contradicts this in the stating 1,325 student stations and 1,193 student capacity @ 90% with 154,364 GSF. Which are we to design and budget against?
A. Please see answer to question 8.
13. Q. Construction documents are requested (Section 2.5.Tab 3.3.a) as a part of the submission for a previous prototype school design.
Should we provide a full set of CDs via a link or just provide floor plans and renderings?
A. Please provide a full set of CDs via a link.
14. Q. The ITN says for Tab 10: Confidential materials shall be submitted in this section – any materials that Respondent asserts as “trade secrets” shall be segregated, clearly labeled, and accompanied by an executed Non-Disclosure Agreement for Confidential Materials (Attachment “E”) and provided in a separate envelope and/or flash drive. However, the provided Attachment E doesn’t reflect Confidential Materials….it says: Request for Approval of Proposed Purchasing Transaction Involving Possible Conflict of Interest. We are under the impression this should be Attachment O (Non-Disclosure Agreement for Confidential Materials). Please confirm.
A. The reference within Tab 10 has been corrected as follows: Tab 10 – Confidential Materials, Performance and Payment
Bond, Audited Financial Statements, and Litigation Information - Weighted Value: Pass/Fail (a score of Fail for this section will disqualify your submittal) (Non-scored) Confidential materials shall be submitted in this section – any materials that Respondent asserts as “trade secrets” shall be segregated, clearly labeled, and accompanied by an executed Non-Disclosure Agreement for Confidential Materials (Attachment “O”) and provided in a separate document.
