About this file

This is an Exemption from Competition (EFC) request form submitted by the Idaho Transportation Department (ITD) to the Idaho Division of Purchasing (DOP) seeking authorization to procure Human Machine Interface (HMI) units directly from Certified Power, Inc. without competitive bidding. The ITD received a fleet of 160 snow plow trucks equipped with data-collection tablets provided by Certified Power, Inc., but these devices have consistently failed to meet operational standards following deployment. The agency requests a one-time direct purchase of replacement HMI units valued at $180,000.00 that are essential for ongoing data collection and operational efficiency in monitoring snow plow operations, deicing agent application, and road conditions. The exemption request was submitted on August 21, 2025, with administrator approval intended pending legal notice as of August 29, 2025.

ITD's justification for exemption from competition rests on Certified Power, Inc.'s offer of a $250 per-unit goodwill credit applicable toward the purchase of updated HMI units to replace the defective tablets whose warranty periods have expired. While the agency acknowledges that competition would technically be possible, it asserts that other vendors would not provide equivalent credits for the defective devices and that the upgraded HMIs offer superior capabilities for capturing more accurate and comprehensive road condition data. The request indicates this is a sole-source procurement based on the vendor's unique willingness to provide the warranty credit and the specific compatibility requirements with existing fleet infrastructure. No set-asides, incumbent contractors, or specific budget allocations beyond the stated $180,000.00 anticipated total cost are identified in the exemption documentation.

Certified Power, Inc. Companies

Duration *

One-Time purchase Ongoing

Anticipated Total Cost * $180,000.00

Background * Describe the circumstances

The Idaho Transportation Department (ITD) recently received a fleet of 160 snow plow trucks, each outfitted with data-collection tablets. These tablets—provided by Certified Powered Inc. Companies and installed by a third-party contractor—were intended to monitor snow plow operations, deicing agent application, and road conditions.

This field has a 500 character limit

Justification * Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?

Following deployment, the tablets have consistently failed to perform to operational standards. A detailed evaluation confirmed that the devices are defective. The warranty period for all 160 units has lapsed.

Certified Powered Solutions has acknowledged the performance issues and has offered a goodwill credit of $250 per unit, which can be applied toward the purchase of new, updated Human Machine Interface (HMI) units. These upgraded devices are essential for ongoing data collection and operational efficiency. The updated HMIs are capable of capturing more accurate and comprehensive road condition data than the original tablets.

Description * Describe the extent to which competition is possible

Competition would be possible, although the vendor community would not offer a credit for defective devices.

Agency Certification *

The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State.
