No such alternate source shall constitute a breach by the City or create any claim for lost volume, exclusivity, or damages.
3.10 Nothing in this Solicitation or any resulting Contract shall be construed to create an exclusive purchasing arrangement unless expressly stated in writing by the City. The City reserves the right to award to one or more responsive and responsible bidders and to place orders with any awarded Vendor based on availability, performance, operational need, pricing, legal compliance, or other contract-based ordering criteria. Where multiple awards are made, ordering may be based upon availability, geographic coverage, emergency response capability, workload balancing, or lowest quoted price for the requested task.
