About this file
This is an Invitation to Bid (ITB) issued by the State of Oregon Department of Administrative Services, Enterprise Goods and Services, Procurement Services on behalf of the Department of Environmental Quality for the purchase of nephelometers for ambient air monitoring. DEQ seeks to procure up to 50 integrating nephelometers that measure in at least two wavelengths for ambient air quality measurement and are certified as Federal Equivalent Method (FEM) by USEPA. The nephelometers must include an internal sample heater, be user-calibratable with carbon dioxide or other gas standards, and communicate data compatible with DEQ's EnviDAS data acquisition software. The initial order will include up to 20 nephelometers with preferred delivery by April 30, 2027, with remaining instruments to be ordered subsequently by purchase order. A voluntary pre-bid conference is scheduled for October 21, 2026 at 10:00 AM Pacific via Microsoft Teams. Written questions and clarification requests must be submitted by November 10, 2026 at 2:00 PM Pacific through the OregonBuys system Q&A tab. Bids are due November 17, 2026 at 1:00 PM Pacific, with bid opening occurring electronically immediately thereafter. The agency anticipates awarding one price agreement with an initial term of ten years from execution, with options to extend. Award will be made to the lowest responsive and responsible bidder based on nephelometer equipment pricing only, with accessories and replacement parts included in the contract for potential future use but not evaluated for award determination.
Bidders must submit pricing for 50 nephelometers on a per-unit basis and provide percentage discounts off catalog price for accessories and replacement parts. The bid must remain firm for 60 calendar days following the bid opening. Bidders must complete and submit mandatory forms including the Bid Cover Sheet, Bid Pricing Form, Responsibility Inquiry, and Certified Disadvantaged Business Outreach Plan. The state will apply reciprocal preferences for out-of-state bidders and recycled materials preferences where applicable. If the price agreement exceeds $500,000 and the bidder has 50 or more employees, a Pay Equity Compliance Certificate from the Oregon Department of Administrative Services is required prior to execution. All bidders must certify they have policies preventing sexual harassment, sexual assault, and discrimination. Bidders must be registered in the OregonBuys e-procurement system and are solely responsible for ensuring current vendor information. The procurement is governed by Oregon Revised Statutes Chapter 279B and Oregon Administrative Rules Chapter 125-247, with venue in Marion County Circuit Court. Protests of the ITB must be submitted within seven calendar days prior to bid opening, and protests of the Notice of Intent to Award must be filed within seven calendar days of issuance.
