1.1 SUMMARY OVERVIEW
The State of Oregon, acting by and through the Oregon Department of Fish and Wildlife, (“ODFW” or “Agency”), is issuing this Invitation to Bid (ITB) to establish one or more Contracts for the purchase of current year, quality, weed free Alfalfa Hay. ODFW prefers Second Crop Alfalfa, but will be accepting alternate pricing for First and Third Crop Alfalfa. Hay is for feeding winter Elk in Baker and Union Counties and will be distributed from ten feeding sites in both counties.
ORS 496.146(9) authorizes the State Fish and Wildlife Commission (“Commission”) to establish and develop wildlife management and refuge areas. ORS 496.146(11) authorizes the Commission to enter into contracts with any person or governmental agency for the development and encouragement of wildlife research and management programs and projects. Acting under the Commission’s direction and in accordance with OAR 635-300-0001 through 635-300-0015, ODFW develops and maintains the Elkhorn Wildlife Area Program.
The goals and objectives of the Elkhorn Wildlife Area Program are:
(1) To mitigate the loss of traditional big game winter range areas along the north, west and south portions of the Powder River Valley through habitat management and supplemental feeding program.
(2) To provide supplemental and subsistence feed for wintering elk and deer to alleviate damage to private lands.
(3) To provide habitat for big game animals and the other wildlife indigenous to the area.
(4) To provide hunting and other wildlife oriented recreation opportunities for the general public.
To meet the requirements of the Elkhorn Wildlife Area Program described above, the Agency needs to procure large amounts of feed.
This purchase is funded with 100% Federal funds. Contract(s) resulting from this ITB incorporate the terms and conditions set forth in the ITB, including without limitation the federal contract provisions for non-federal entity contracts under federal awards set forth in Attachment A.

(B) All contracts in excess of $10,000 must address termination for cause and for convenience by the non-Federal entity including the manner by which it will be effected and the basis for settlement.
(C) Equal Employment Opportunity. Except as otherwise provided under 41 CFR Part 60, all contracts that meet the definition of “federally assisted construction contract” in 41 CFR Part 60-1.3 must include the equal opportunity clause provided under 41 CFR 60-1.4(b), in accordance with Executive Order 11246, “Equal Employment Opportunity” (30 FR 12319, 12935, 3 CFR Part, 1964-1965 Comp., p. 339), as amended by Executive Order 11375, “Amending Executive Order 11246 Relating to Equal Employment Opportunity,” and implementing regulations at 41 CFR part 60, “Office of Federal Contract Compliance Programs, Equal Employment Opportunity, Department of Labor.”

In addition, contractors must be required to pay wages not less than once a week. The non-Federal entity must place a copy of the current prevailing wage determination issued by the Department of Labor in each solicitation. The decision to award a contract or subcontract must be conditioned upon the acceptance of the wage determination.
