1.5. Mandatory Requirements
The Department has established certain requirements with respect to bids to be submitted by respondents. The use of “shall”, “must” or “will” (except to indicate simple futurity) in this ITB indicates a requirement or conditions from which a material deviation may not be waived by the Department. A deviation is material if, in the Department’s sole discretion, the deficient response does not substantially comply with the ITB requirements, provides an advantage to one vendor over other vendors, has potentially significant effect on the quantity or quality of items bid, or on the cost of the Department. Material deviations cannot be waived. The words “should” or “may” in this ITB indicate desirable attributes or conditions but are permissive in nature. Deviation from, or omission of, such a desirable feature, will not in itself cause rejection of a bid.
1.6. Conflicts and Order(s) of Precedence
All bids are subject to the terms of the following provisions of this ITB, which are hereby incorporated by reference, and in case of conflict shall have the following order of precedence:
1) Addenda, in reverse order of issuance.
2) ITB, including attachments and appendices.
3) PUR 1001, General Instructions to Respondents; and
4) PUR 1000, General Contract Conditions.
SECTION 2.0 TECHNICAL SPECIFICATIONS
2.1. Scope of Work
This ITB seeks a vendor to provide all labor, herbicide, materials, tools, transportation, and supervision required for aerial herbicide treatment and control of melaleuca (Melaleuca quinquenervia) across approximately 2500 acres within Picayune Strand State Forest. The presence of these invasive trees disrupts natural ecological processes and creates a significant wildfire risk. Aerial herbicide application will be scheduled to take place during May 2026 to take advantage of seasonal environmental conditions.
Given the extent of infested acreage and the density of the melaleuca trees, ground treatment with herbicide is unrealistic; therefore, the Florida Forest Service (FFS) specifically seeks aerial herbicide application to kill these invasive plants.

2.2. Description and Location
The approximate 2500-acre treatment area is within Picayune Strand State Forest (Appendix I - Map), located east of Naples, Florida, and consists of mixed natural plant communities that have been invaded by invasive Australian melaleuca trees. ArcGIS shapefiles depicting the treatment area boundaries will be emailed to the contractor prior to the start of treatment work, and a pre-treatment meeting with the FFS Project Manager will be scheduled with the contractor to answer any specific site questions prior to the commencement of work.
Nearby areas of interest/concern for aerial work are:
• Interstate 75 – north of project
• Naples residential areas – west of project
• Private organic farm – immediately northwest of landing zone/staging area
• Naples Airport – west of project
2.3. Treatment Specifications and Instructions
2.3.1. Access to Project Area
Access routes to the treatment areas, types of vehicles used, and location of work areas must be approved by the FFS Project Manager prior to treatment. County and Forest Service roads provide access to the treatment area and to nearby equipment staging areas. A clearing suitable as a landing/refueling site is located on the west side of a quarry lake southeast of the treatment area. This staging area has direct access from Sabal Palm Road.
Additionally, an established helicopter landing site is located five (5) miles east of the project at the state forest field office and Naples Airport is located eight (8) miles west of the project. Access to the staging area is gated but a lock combination will be provided.
The contractor is permitted to stage equipment on-site at their own risk during the project.
2.3.2. Herbicide Mixing and Storage
Herbicide mixing and storage areas will be established and approved by the FFS Project Manager. The contractor will dispose of all trash and herbicide containers off-site.
Herbicide rinsing will be managed per label directions. The nearest water source will be a quarry lake at the staging area. The contractor must supply pumps and equipment necessary to draw water. Large water containers or large batch mixes will be permissible.
Water may also be obtained at the Picayune Strand State Forest office (2121 52nd Ave SW, Naples, Florida 34117).
2.3.3. Treatment Procedure
Aerial herbicide application shall be performed on the project area in a manner that minimizes impacts to non-target species, the environment, and the public. The contractor has full responsibility for systematically treating all target plants in the project area. The project area should be treated completely (100% coverage) and a minimum of 95% of the treated melaleuca should be dead within 3-4 months of project completion.
Areas not treated or not responding to treatment will be required to be retreated at the contractor’s expense if it is determined that the contractor provided faulty treatment measures as evidenced by lack of coverage according to GPS tracks or insufficient plant mortality. The contractor or their representative must have a pre-treatment meeting with the FFS Project Manager before the commencement of any work.
The recommended treatment methods are outlined below. Other methods/herbicides can be used if approved in advance by the FFS Project Manager. For all mature trees, saplings, and seedlings:
• Aerially broadcast/foliar spray with VELPAR-L (Hexazinone) according to label rate, typically around two (2) gallons (concentrate) per acre with a 10-20 gallons per acre application rate. To reduce labor cost, all treated vegetation will be left standing to decompose on-site.
• Aerial application nozzles should be capable of spraying Velpar-L herbicide.
Nozzle sizes of 0.033 to 0.05 are generally considered acceptable.
2.3.4. Timing and Weather Conditions
Suitable weather and environmental conditions are required for chemical treatments to be effective. The FFS Project Manager shall have responsibility for determining when suitable conditions exist, and the right to delay, suspend, or terminate herbicide application operations.
Timing: Velpar-L herbicide requires rainfall within 1 - 3 weeks for activation. Aerial application of Velpar-L will be timed to coincide with the onset of the summer rainy season, typically in middle to late May 2026.
Rain: Herbicide application will not be allowed during rainy conditions. Areas receiving rainfall within three (3) hours following treatment may require re-treatment at the discretion of the project manager.
Wind: Herbicide application will not be permitted when sustained winds are greater than 10 miles per hour, to prevent drift to non-target species.
On-the-Ground Flooding: Velpar-L herbicide cannot be used if standing water is present in the treatment area. If unforeseen large areas of standing water are discovered within the treatment area upon initiation of treatments, the FFS Project Manager will attempt to identify alternate dry sites of equivalent acreage that are suitable for treatment.
Smoke: Prescribed burning may take place elsewhere on the forest at the same time as scheduled treatments, potentially causing visibility concerns. No prescribed burning will take place directly in/near the project area while aerial treatments are taking place. The contractor will be notified in advance of any potential concerns with drift smoke or the presence of FFS aircraft in the vicinity.
2.4. Special Precautions
A small organic farm is located northwest of the planned landing/refueling zone. The contractor shall avoid overflights of this farm.
2.5. Label and Safety Adherence
The contractor will strictly adhere to all herbicide label application, precautionary, and safety statements and shall be familiar with and adhere to the Service safety requirements. The contractor shall also adhere to all federal, state, and local regulations governing the application, transportation, storage, use and disposal of products utilized in the performance of this agreement. These regulations include at a minimum, Federal Insecticide, Fungicide and Rodenticide Act 29 CFR 1910, OSHA General Industry Standards, and Chapter 487, F.S.
2.6. Data Collection
The contactor is responsible for collecting and providing treatment data for the FFS. Herbicide data must be recorded using the approved Herbicide Application Record (Appendix II – Herbicide Application Record). The contactor will also collect and provide GPS track data detailing the area worked each day. The contractor will email the FFS Project Manager with all GPS tracks and Herbicide Application Record forms upon submission of each invoice.
2.7. Estimated Quantities
The estimated acres are given only as a guideline for preparing your bid and should not be construed as representing actual acreage to be treated under this contract. The total acreage may increase, or decrease based on the winning vendor’s quote. Any additional acreage will be calculated at the quoted rate and clarified in writing with the winning vendor. Chemicals shall only be applied within the project area or additional area to be identified if site acreage is increased.
2.8. Site Visitation
It is STRONGLY recommended that each vendor, before submitting a bid, inspect the site where the project is to be completed to satisfy themselves regarding all general and local conditions that may affect the preparation of their bid and cost of contractor’s performance. Appointments for site inspection may be arranged with a Florida Forest Service Representative, Mike Knight, (239) 690-8032, Mike.Knight@fdacs.gov, between the hours of 9:00 a.m. to 4:00 p.m., Monday through Friday. It is the vendors' responsibility to consider all site conditions or requirements for the project. A site visit is recommended but IS NOT mandatory.
2.9. Licensing
Vendors must furnish all appropriate certification and licensing pertaining to this job including a copy of their state of Florida restricted use pesticide applicators license, issued under Chapter 487, Florida Statutes, with their bid submission. Failure to provide proof of license may result in the rejection of your bid.
The contractor must have a Florida Department of Agriculture Commercial Applicator’s license and must show the license to the FFS Project Manager before the commencement of any work.
The contractor shall maintain valid certifications, licenses, and permits required for the services prescribed above for the duration of the contract period.
2.10. Past Performance/References
The bid response must contain names, addresses, phone numbers and email contacts for three
(3) of the vendor’s most recently completed projects from the last five (5) years, similar in project size and scope as the work outlined in Section 2.1, Scope of Work, (See Attachment A - Past References/ References). References must be current or former clients of the responding vendor. Confidential clients shall not be included. The Department will not accept subcontractor/proposed personnel or personal references of a member of the responding vendor as a substitute for respondent references.
mailto:Mike.Knight@fdacs.gov
The Department reserves the right to contact each customer reference to verify the information provided and validate the performance / workmanship of the vendor. If determined by the Department, references must be verifiable within three (3) business days of initial verification attempt by the Department, exclusive of weekends, state holidays or other closures.
It is the responsibility of the vendor to ensure that all submitted references are verified. The Department will attempt to verify references once via telephone or email. Bids with one or more unverified references may be disqualified. References that indicate any unsatisfactory vendor work performance or workmanship may result in disqualification of the bid. Past performance with the Department will constitute a reference, whether listed or not, and will be used by the Department to determine the respondent's ability to perform services similar to those described in this bid in a satisfactory manner. Unsatisfactory past performance with the Department may result in rejection of bid.
