1.5. Mandatory Requirements

The Department has established certain requirements with respect to bids to be submitted by respondents. The use of “shall”, “must” or “will” (except to indicate simple futurity) in this ITB indicates a requirement or conditions from which a material deviation may not be waived by the Department. This ITB seeks competitive bids for herbicide treatment of invasive plants within two zones comprising approximately 356.9 acres identified for treatment within the Seminole State Forest.

The contractor shall provide all labor, materials, equipment, tools, transportation, supplies, supervision, and personal protective equipment (PPE) required for their staff to complete the task successfully and provide the application services in accordance with the specifications listed herein.

The contractor must use application equipment acceptable to the FFS (as specified herein).

Failure to fulfill the requirements of Section 2.0, Technical Specifications may prevent the Vendor from being considered for future contracts for a period of up to three (3) years.

2.2. Technical Specifications

The contractor shall perform herbicide treatment of invasive plants on two areas consisting of approximately 356.9 acres within Seminole State Forest located in Lake County Florida. (See Appendix I for treatment sites).

Zone 1: The project area in Zone 1 is approximately 326.6 acres (Appendix II). In this zone, all Florida Invasive Species Council (FISC) Category 1 invasive plants must be treated. The invasive plants are scattered throughout the project area, with an estimated coverage ranging from less than one percent (<1%) up to 14%. Invasive species known to occur in the project area include cogongrass, Caesar’s weed, natalgrass, sword fern, tropical soda apple, camphor-tree, and Chinese tallow-tree. The contractor must cover the entire treatment zone.

Zone 2: The project area in Zone 2 is approximately 30.3 acres (Appendix III). Cogongrass is the only invasive species required to be treated in this zone. The estimated coverage of cogongrass ranges up to 30%. The contractor must cover the entire treatment zone.

Zone 1 and 2 project areas will be identified by roads, forest boundaries, natural boundaries, timber marking paint, flagging tape, and/or GPS/GIS files. Treatment areas and boundaries will be reviewed with the contractor prior to starting work on this project, and GIS files (ESRI shapefiles) will be provided upon the request of the contractor.

Herbicide shall only be applied within the treatment zones identified. Applications of herbicide must be performed in such a manner as to protect non-target organisms, the environment, and the public. The contractor has full responsibility for systematically treating all designated invasive plants in the project areas. The project areas should be searched completely (100% coverage). A spray indicator (dye) or colored bark oil will be required to allow identification of treated invasive plants. If it is determined that the contractor provided faulty treatment measures, as evidenced by lack of dye on target vegetation, or lack of visitation by GPS tracks, additional treatments will be required at the contractor’s expense. Control efforts shall be at least 90% effective in preventing re-sprout of all designated invasive plants within three months of the completion of the project.

The contractor shall conduct additional treatments to achieve 90% control of all designated invasive plants, at contractor's expense, as determined by project manager.

2.3. Reporting Requirements

The contractor is responsible for collecting the following data: treatment date; treatment location (treatment area worked in longitude and latitude); control method; herbicide mix and volume used; number of applicators; hours worked, and weather conditions. The contractor will also collect GPS data information detailing the area worked each day, in the form of GPS tracks. On a weekly basis, the contractor will provide to the project manager all GPS units so that GPS tracks for the previous week can be downloaded and archived.

2.4. Access to Treatment Sites

Vehicle access to all zones and general work areas must have prior approval by the project manager or their designee. Off-road vehicle use will be necessary and will be permitted along routes approved by the project manager. Areas where vehicles are not permitted will require access on foot. Gate combinations will be provided to allow access to the treatment zones. The gates will be kept closed unless specified by the project manager. There are no public hiking trails in the treatment zones. FFS will not be responsible for freeing stuck machinery. The contractor must have the ability and resources to free machines that become stuck without causing excessive damage to the soil, vegetation, trees and/or forest infrastructure.

2.5. Equipment and Personnel Requirements

The contractor must use spraying equipment acceptable to the FFS to treat all Category 1 invasive species listed on the FISC 2023 List of Invasive Plant Species located within Zone 1, and all cogongrass located in Zone 2.

All equipment used must be approved by the FFS project manager or other designated FFS official. Equipment must be decontaminated and free of invasive plant material prior to moving onto Seminole State Forest, between project sites, and when departing Seminole State Forest.

The contractor shall apply herbicide using adjustable sprayer nozzles (e.g., bronze-type, adjustable nozzles) to reduce non-target spray. Mechanized sprayers and backpack sprayers that can hold at least three (3) gallons shall be required. The project manager may approve the use of all-terrain or utility vehicles with mounted spray tanks.

All equipment, including but not limited to, vehicles, trailers, and ATVs must be cleaned with a pressure washer to reduce the spread of invasive plants prior to initiating work activities on Seminole State Forest. All equipment must also be cleaned prior to removing from each project area. Decontamination protocols include spraying down all equipment surfaces including the undercarriage and tires to ensure that mud, sand, dirt, muck, vegetative debris, and other debris are not transported from the project area. All hand-held equipment to be used for treatment activities must be wiped down and cleaned so that they are free of debris.

The contractor will furnish sufficient personnel and equipment to complete the project in the time allowed. If adverse weather causes delays, the contractor must furnish additional personnel and equipment to make up for lost time and ensure timely completion of the project. Operations cannot stop for a period longer than 48 consecutive hours without approval of the project manager. Personnel problems must be resolved to ensure delays are minimized. If the contractor is using laborers which do not speak English, the contractor shall provide a crew supervisor that is fluent in both English and the language of the crew. The contractor shall have an on-site crew supervisor, who shall hold a valid FDACS pesticide applicator license in the Natural Areas Weed Management category, on site whenever work is performed. The on-site supervisor shall be responsible for crew safety and all crew activities while crews are on the site. The contractor shall provide the name of the on-site crew supervisor, his/her cell phone contact number and a copy of his/her FDACS pesticide applicator license before work is performed.

All equipment will be operated in a manner to cause the least disturbance to the soil. The contractor will be permitted to store their equipment on site at a location identified by the FFS contract manager. The Department is not responsible for any of the contractor’s equipment.

2.6. Herbicide Mixing and Storage

The contractor must furnish all herbicides, non-ionic surfactant, bark oil, and blue or red marking dye. Nearest water source areas will be established and approved by the project manager for the treatment area, based on water levels. The contractor will supply pumps and equipment necessary to draw the water. Large water containers or large batch mixes will be permissible.

Water can be obtained at the Florida Forest Service tower site in Paisley, Florida, approximately 6 miles east of Zone 1 and at the game check station, approximately 2.5 miles south of Zone 2.

Contractor employees shall use all appropriate safety gear while engaged in spraying operations and follow all label directions for herbicides.

Mixing and storage areas will be established and approved by the project manager. The contractor will dispose of all trash and herbicide containers off-site. Herbicide rinsing will be managed per label directions.

The contractor will strictly adhere to all herbicide label application; precautionary and safety statements and shall be familiar with and adhere to the Department safety requirements. The contractor shall also adhere to all federal, state, and local regulations governing the application, transportation, storage, use, and disposal of products utilized in the performance of this contract.

All chemicals are to be applied in such a manner that public property adjacent to project area is unaffected. Contractor shall be liable for damage resulting from an herbicide spill or contamination.

All damages to the property that occur in the course of work and its entities are to be repaired by the contractor in a timely manner by the end of the contract.

2.7. Requirements for Herbicide Application

Due to the presence of natural community types that are hydric in nature within and adjacent to the treatment zones, the contractor must utilize aquatic/wetland labeled products, as needed, where standing water exists. If there is no standing water in the treatment area at the time of treatment, upland-labeled herbicides can be used, or surfactant can be added to the aquatic-labeled herbicide mix to increase the effectiveness of the herbicide. The recommended treatment methods are outlined below.

A dye shall be used with all treatments to allow identification of treated invasive plants. The contractor should make every effort to avoid damage to native vegetation and wildlife.

Description Treatment Guidelines

Large and small woody plants to include Chinese tallow-tree and camphor-tree

Treatment of large woody plants shall either be cut-stump, cut-stem, frill or girdle application of 20% Triclopyr 4 with bark oil. For small woody stems less than 6 inches basal diameter, a basal bark application of 20% Triclopyr 4 with bark oil shall be applied to the tree trunks to a height of 12 to 15 inches from the ground.

Treated vegetation shall be left standing to decompose on site, except for cut stump applications of herbicide where felling the tree is required.

Herbaceous plants and small woody plants to include cogongrass, Caesar’s weed, natalgrass, sword fern, and tropical soda apple

A solution of 2% glyphosate shall be used on herbaceous plants and small woody plants, spraying foliage as much as possible but not allowing for runoff of foliage. Up to 0.5% imazapyr can be added to facilitate kill of cogongrass. Care should be taken to avoid non-target damage with the use of imazapyr. Surfactants shall be added to aquatic labeled herbicides, or upland-labeled herbicides shall be used, if no standing water is present at time of treatment.

Seedlings

Seedlings shall be hand pulled and left hanging on other vegetation or put in a pile and sprayed with the glyphosate herbicide mix to reduce the possibility of re-sprouting within the pile. When conditions dictate, seedlings shall be treated with herbicide, as approved by the project manager.

The contractor shall permit Department personnel to confirm chemical concentrations and application rates per acre.

2.8. Estimated Quantities

The estimated acres are given only as a guideline for preparing your bid and should not be construed as representing actual acreage to be treated under this contract. This may increase or decrease based on the winning bidder’s quote. Any additional acreage will be calculated at the quoted rate and clarified with the winning vendor. Chemicals will only be applied within the project area or additional area to be identified if site acreage is increased.

2.9. Site Clean Up

Upon completion of services, the contractor shall remove all trash and debris from the site and leave area in same condition as provided by the Department. The Department's trash facilities shall not be used for the disposal of any products used in the completion of these services. All debris created by the contractor in conjunction with these services shall be hauled away and disposed of appropriately. The Department will not pay for hauling, dumping, tipping, trash, hazardous waste fees or other related waste fees.

2.10. Weather Conditions

Rain: Herbicide application will not be allowed during rainy conditions. Areas receiving rainfall within three hours following treatment may require retreatment at the discretion of the project manager.

Fog: Herbicide application will not be allowed in fog or when there is a danger of applying the chemicals in a fog bank. Defining fog conditions will be the sole responsibility of project manager.

Wind: Herbicide application will not be permitted when sustained winds are greater than 10 miles per hour, to prevent drift to non-target species.

2.11. Resource Protection

The contractor shall perform the work in a safe and careful manner and will furnish and use such safety devices, methods, and measures as are required to protect contractor and employees thereof, Department personnel, and the general public against bodily injury and/or damage to property.

Protection of native communities: Due to the highly aggressive nature of invasive plants, the contractor must take care not to further spread any invasive plant on any state forest. No soil disturbing activity may take place in areas infested by invasive plants. The project manager will identify all infested areas that must be avoided in the project pre-work meeting. All soil disturbing equipment, including all vehicles, must be cleaned of soil and plant material prior to entry onto and removal from the site.

Protection of archeological/historical resources: The contractor, upon the discovery of suspected archeological or historical material, shall cease to work in the vicinity of such material and immediately notify the project manager.

Protection of faunal species: The contractor shall use every precaution necessary to prevent disturbing and harassment of wildlife encountered on state managed lands. The willful killing of any animal species (i.e. amphibians, birds, fish, mammals or reptiles) while working on state managed lands will not be tolerated. Violations will void the contract, and the contractor may be subject to prosecution under appropriate wildlife laws.

Protection of streams, lakes, reservoirs, and wetlands: Contractor shall use every precaution necessary to prevent pollution of streams, lakes, and reservoirs by fuels, oils, other chemicals, silt, or other harmful materials. All streams, lakes, and reservoirs shall be kept free of contractor-generated debris. Contractor shall use every precaution necessary to prevent pollution of wetlands and ditches, by fuel, oils, other chemicals, silt, or other harmful materials. All wetlands and ditches will be kept free of contractor-generated debris.

Best Management Practices: Contractor shall adhere to and implement all applicable best management practices for silvicultural operations as outlined in the current Silviculture Best Management Practices Manual.

2.12. Recommended Pre-Bid Conference / Site Visitation

It is STRONGLY recommended that each vendor, before submitting a bid, inspect the site where the project is to be completed to satisfy themselves regarding all general and local conditions that may affect the preparation of their bid and cost of contractor’s performance. Access for site inspection must be arranged with a Florida Forest Service Representative, Joe Bishop at (352) 589-1762, between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. It is the vendors' responsibility to consider any and all site conditions or requirements for the project. A site visit is recommended but IS NOT mandatory.

NOTE: No ATVs will be needed for the site visit; however, a four-wheel drive vehicle with off road ground clearance is recommended. Instructions for travel to the treatment sites will be provided by the Florida Forest Service Representative.

2.13. Project Period

The anticipated contract period for the project will begin upon the issuance of the Department’s purchase order through June 30, 2025. The start and end dates may be changed by the Site Manager or his/her designee if field conditions are not suitable for effective treatment. The initial treatment should begin upon receipt of the purchase order (weather permitting) and contract manager approval. Treatment evaluation will begin 30 days after project completion.

Retreatments will need to be done within 60 days of notice.

2.14. Licensing

Vendors must furnish all appropriate certification and licensing pertaining to this job including a copy of their state of Florida restricted use pesticide applicators license, issued under Chapter 487, Florida Statutes, with their bid submission. Failure to provide proof of license may result in the rejection of your bid.

Vendors must possess and provide proof of a certified commercial applicators license in either the natural areas weed management or the aquatic category. Ground crew supervisors that are assigned to this project shall possess and provide proof of a certified commercial applicators license in either the natural areas weed management or the aquatic category.

Contractor shall maintain valid certifications, licenses, and permits required for the services prescribed above.

2.15. Past Performance/ References

References must be current or former clients of the responding firm. Confidential clients shall not be included. The Department will not accept subcontractor/proposed personnel or personal references of a member of the responding firm as a substitute for respondent references.

The Department reserves the right to contact each customer reference to verify the information provided and validate the performance/workmanship of the Bidder. If determined by the Department, references must be verifiable within three (3) business days of initial verification attempt by the Department, exclusive of weekends and holidays.

It is the responsibility of the contractor to ensure that all submitted references are verified. The Department will attempt to verify references once via telephone or email. Bids with one or more unverified references may be disqualified. References that indicate any unsatisfactory contractor work performance or workmanship will result in disqualification of the bid. Past performance with the Department will constitute a reference, whether listed or not, and will be used by the Department to determine the respondent's ability to perform services similar to those described in this bid in a satisfactory manner. Unsatisfactory past performance with the Department will result in rejection of that bid.

2.16. Sub-Contractors

In order to ensure that only qualified and competent subcontractors will be employed on the project, the contractor shall submit to the Department a list of subcontractors who will perform work. Subcontractors include facilities used for final disposal of collected pesticides and other materials. The contractor shall have determined, to his own complete satisfaction, that a listed subcontractor has been successfully engaged in this particular type of business for a reasonable length of time and is qualified both technically and financially to perform the phase of this work for which he is listed. Proof of any licenses or certifications required of subcontractors shall be submitted with the list of subcontractors by the contractor.

Any subcontractor(s) not listed and approved in the award of this bid will not be allowed to proceed with any work related to this project. The Department shall have the right to examine the technical qualifications of any subcontractor and to request additional documentation of a subcontractor’s technical and financial qualifications.
