SUBMISSION REQUIREMENTS

10.1 Required Bid Submission Items

Your Bid Submission must consist of the following:

Bid Schedule Provide your cost information on Attachment 2, Bid Schedule, below. Do not submit your Bid on any other form. Submitting your Bid on a form different than the Bid Schedule may cause your Bid to be rejected as non-responsive.

State of Idaho Signature Page The State of Idaho Signature Page must be completed and submitted as part of your Bid. The State of Idaho Signature Page is attached in IPRO.

10.2 Bid Submission Methods

Bids must be submitted electronically via IPRO. Do not fax or e-mail your Bid. Your Bid must be received at the Division of Purchasing by the date and time specified on the IPRO header document. The official time, for bid closing purposes, is the Division of Purchasing’s time clock.

10.2.1 Electronic Submission via IPRO

When submitting electronically via IPRO, upload all of the Required Bid Submission Items (See Section 10.1) and enter your cost in IPRO for each line item; as the “Total Cost” on the Bid Schedule OR $0.01 as your cost in IPRO.

Upload all Required Bid Submission Items using Microsoft products such as Word and Excel. Do not submit items in .pdf format, unless provided otherwise in this ITB.

When submitting via IPRO, be advised that that the Bidder for Bid evaluation and award purposes is the entity profile under which submit in IPRO, which must be the same legal entity presented in your uploaded response materials. If the entity identified on the state supplied Signature Page differs from the entity under which you submit your Bid in IPRO, the information provided on the Signature Page prevails.

It is mandatory to submit your Bid electronically via IPRO, all Bidders participating in a Solicitation issued through IPRO must establish an account in the IPRO system as it is necessary in order to process and/or award the resulting Contract(s). It is free to establish an account and only takes a few minutes.

Bidders are further advised to upload response materials with descriptive file names, organized and consolidated in a manner which allows the State to efficiently navigate the Bidder’s response; as the State will print uploaded documents for evaluation in the manner received via IPRO.

10.3 Trade Secrets

If your Bid contains trade secret information which you have identified, you must also submit a redacted copy of the Bid (in electronic format, with the word “redacted” in the file name) with all trade secret information removed or blacked out; as well as a separate document containing a complete list (per the instructions in the three (3) paragraphs directly below) of all trade secret information which was removed or blacked out in the redacted copy.

Paragraph 28 of the Solicitation Instructions to Vendors describes trade secrets to “include a formula, pattern, compilation, program, computer program, device, method, technique or process that derives economic value, actual or potential, from not being generally known to, and not being readily ascertainable by proper means by other persons and is subject to the efforts that are reasonable under the circumstances to maintain its secrecy.” In addition to marking each page of the document with a trade secret notation (as applicable; and as provided in Paragraph 28 of the Solicitation Instructions to Vendors), Bidders must also:

Identify with particularity the precise text, illustration, or other information contained within each page marked “trade secret” (it is not sufficient to simply mark the entire page). The specific information you deem “trade secret” within each noted page must be highlighted, italicized, identified by asterisks, contained within a text border, or otherwise clearly delineated from other text/information and specifically identified as a “trade secret.”

Provide a separate document entitled “List of Redacted Trade Secret Information” which provides a succinct list of all trade secret information noted in your Bid; listed in the order it appears in your submittal documents, identified by Page #, Section #/Paragraph #, Title of Section/Paragraph, specific portions of text/illustrations; or in a manner otherwise sufficient to allow the State’s procurement personnel to determine the precise text/material subject to the notation. Additionally, this list must identify with each notation the specific basis for your position that the material be treated as exempt from disclosure.

EVALUATION AND AWARD

11.1 Evaluation process

11.1.1 All Bids will be reviewed first to determine if they meet the mandatory submissions requirements and specifications of the ITB. Any Bid not meeting the mandatory submission requirements or specifications may be deemed non-responsive and receive no further consideration.

11.1.2 All responsive Bids will be evaluated based on the offered Bid Price and any applicable preferences.

11.1.3 Pursuant to IDAPA 38.05.01.081, the ITB Lead may, in the State’s sole discretion, require the apparent low-cost Bidder to provide documentation to demonstrate its responsibility. The ITB Lead may request documentation including, but not limited to credit or financial reports and customer references. Failure to provide requested documentation may result in the Bid being deemed non-responsive. Nothing herein shall prevent the State from using other means to determine Bidder’s responsibility.

11.2 Award

Award of contract(s) will be made, by line item or all to one as determined to be in the best interest of the State, either by Direct Purchase or Direct Purchase with Buy-Back, to the lowest responsible Bidder, deemed to be the responsive and responsible Bidder offering the lowest Bid Price. The State reserves the right to award multiple contracts pursuant to Idaho Code section 67-9211.

Note: IDAPA 38.05.01.074.03 and 38.05.01.091.05 allow the designated State official to waive minor informalities as well as minor deviations. The State also reserves the right to seek clarification of Bidder’s responses and to engage in discussions or negotiations as determined to be in the best interest of the State and permitted by IDAPA 38.05.01.084.

11.2.1 ITD reserves the right not to award all line items.

11.2.2 The calculation will be based on the monthly ownership cost as outlined below, to determine which Bid(s) is/are in the best interest of the State.

Direct Purchase:

The monthly ownership cost will be determined by straight-line depreciation, with the monthly depreciation being the monthly ownership cost. ITD utilizes a twenty percent (20%) salvage value with a useful life of twelve (12) years.

Example:

Unit Price $150,000

Annual Depreciation(Unit Price x 0.80) / Useful Life
($150,000 x 0.80) / 12 = $10,000.00
Monthly DepreciationAnnual Depreciation / Useful Life
(Monthly Ownership Cost)$10,000.00/ 12 = $833.33

Direct Purchase with Buy-Back The monthly ownership cost will be determined as follows: Subtract the Buy-Back Price from the Unit Price and divide that amount by the respective number of months of ownership; then, add the loss of interest on the Unit Price to that monthly amount. The loss of interest on the Unit Price will be calculated by the difference in the Unit Price and the lowest Unit Price offered among all Bidders. This will be calculated at a five percent (5%) simple interest annually.

Example:

Bidder A
Bidder B
Unit Price
$150,000
$155,000
Buy-Back Price
$142,000
$150,000
Buy-Back Date
April 1, 2025

(19 months of ownership) November 1, 2025 (19 months of ownership)

$150,000 - $142,000 19 months $421.05 per month $155,000 - $150,000 19 months $263.16 per month

Loss of Interest

($150,000 - $150,000) x .05 12 months $0 per month ($155,000 - $150,000) x .05 12 months $20.83 per month

Monthly Ownership Cost
$421.05 + $0

$421.05 per month $263.16 + $20.83 $283.99 per month

Evaluating Award Options: Based on the methods and examples above, the Direct Purchase with Buy-Back from Bidder B offers the State the lowest monthly ownership cost. This would be the bid determined to be in the best interest of the State.

Bidders may offer the direct purchase, the purchase with Buy-Back option, or both. Bidders do not have to bid on all line items to be considered for an award; however, for each line item you bid, you must bid on all quantities requested for that line, for the Direct Purchase or the Direct Purchase with Buy-Back.

Buy-Back Contract If the Buy-Back option is awarded, the Contractor must complete and submit Attachment 5 - Buy-Back Contract (including the Surety Payment Bond) to DOP prior to the delivery of the loaders to ITD. The Bonding Surety must be registered and licensed with the Idaho Department of Insurance. The Surety Payment Bond will not be accepted if Surety is not registered and licensed in Idaho, and the Contract will not be executed by the State. If the Contractor fails to present an acceptable bond, this failure may be deemed just cause for the cancellation of the award of the Contract.

authorized distributor/manufacturer Submitting vendors must be an authorized distributor or manufacturer of the 3 CY & 4 CY Loaders offered. An authorized distributor shall be defined as a company or organization that has a written agreement with the manufacturer to sell or service its products. Bids from Contractors who are not an authorized distributor by the manufacturer shall not be considered.

ITD reserves the right to request authorized distributor documentation from the submitting vendors. Failure to provide submitting documentation as requested will result in a non-responsive quote.

Dealers and salesman license and manufacturer’s statement of origin Bidders must comply with Idaho Code, Section 49, Chapter 16, “Dealers and Salesmen Licensing”. The dealer furnishing the 3 CY & 4 CY Loaders must provide the original MSO and an ITD0502, Report of Sale and Application for Certificate of Title, directly to ITD upon payment of completed 3 CY & 4 CY Loaders to the Contractor for titling as new 3 CY & 4 CY Loaders.

Acceptance ITD will take thirty (30) days to inspect the goods appropriately. In the event the specifications are not met, the Contractor must pick-up loaders, correct any discrepancies, and re-deliver loaders within thirty (30) calendar days after notification from ITD, at no additional cost to ITD.

Warranty, Service and Support, Maintenance, etc.

18.1 If the Direct Purchase is awarded: Warranty must be for a minimum period of five (5) years or 5,000 hours, whichever comes first, for the entire loader, after ITD’s Acceptance.

18.2 If the Buy-Back is awarded: Warranty must be for the entire period of the Buy-Back Contract.

18.3 Warranty must include all parts, labor, and freight to replace a defective warranted item. Warranty excludes routine lubrication, fuel, oil, tires, antifreeze, lights, paint, fuses, glass, and other manufacturer’s auxiliary attachments.

18.4 Awarded vendor is responsible for all warranty requirements. No third-party warranties will be allowed.

PREVENTATIVE MAINTENANCE (BUY-BACK ONLY)

If the Buy-Back is awarded: ITD will be responsible in performing preventative maintenance on the loaders, following the manufacturer’s suggested maintenance intervals for oil changes, fluid changes, and necessary adjustments during the duration of the Buy-Back Contract, except for the two hundred and fifty (250) hr. Brake System Test, which includes the Park Brake Test and Adjustment. The Contractor will be responsible for all costs associated with the Test, adjustment. ITD will be responsible in performing all non-expected repairs, not covered under warranty, during the duration of the Buy-Back Contract.

INSPECTIONS AND RETURNS (BUY-BACK ONLY)

If the Buy-Back is awarded: The Contractor must perform an inspection on each loader two (2) weeks prior to the Buy-Back Date at each Delivery Location. The Contractor is responsible for the following:

Travel time, mileage and any other expenses related to performing the inspection.

Suggesting any manufacturer adjustments needed to ensure the Loaders are returned as close to original delivery condition as possible.

20.3 Report any defects or repairs that need to be corrected to the ITD Maintenance Services Manager or designee.

Once the Inspection has been completed and the Buy-Back contract has ended, the Contractor must pick up the loaders from each Delivery Location. ITD will ensure the loaders are maintained in as good condition as when received, with any defects or repairs corrected, prior to the Buy-Back Date (ordinary wear, tear, and defects are to be expected).

FLUID FILTERS (BUY-BACK ONLY)

If the buy-back is awarded; all fluid filters must be supplied to the delivery locations for each loader for the duration of the buy-back contract. All filters must be provided per manufacturer’s scheduled service intervals detailed in operator’s manual. ITD will average three hundred (300) hours, on each loader, in a twelve (12) month period.
