Per 6.302-1(c)(ii)(C), The justification shall be posted with the solicitation (see 5.102(a)(6) and 16.505(a)(4)(iii)(A)).

5. If the answer to No. 4 is “no,” complete the following:

A. Because of patent rights, copyrights, propriety secret processes, control of certain materials or components providing superior utility or capability, purchasing a different/similar product cannot be obtained. See below for explanation.

B. Because program requirements cannot be modified so that competitive products or services may be used. See below for explanation.

C. Because the product or service is unique and easily established as on-of-a kind. See below for explanation.

6. If the answer to No. 4 is “no,” please indicate reason(s) for restricting competition.

The only restriction under this action is the utilization of brand name specifications based on the following facts:

The Dell product is a direct copy of the hardware which is currently installed in the Tucson area Office server room. The Dell Power Protect Data Manager (PPDM) product is required at the remote end (Albuquerque IHS Data Center) to provide replication of the data. In accordance with IHS Data Center personnel it was determined this solution would provide the best solution for long-term protection of the data assets. The Dell PPDM currently installed will not interface with other remote replication/back up products produced by other manufactures. This action is for the procurement of IT hardware services. No other brand name hardware appliances can accomplish this functionality because no other product can communicate or integrate with the existing hardware due to these propriety constraints.

2. Description of “brand name” product: The Dell hardware system is required for data assets. The hardware will provide a long-term data protection for the Tucson Area office.

4. The “brand name” provided is to identify the standard of quality necessary. Equivalents can/will be considered:

Indicate other reasons for restricting competition:

The Tucson Area Office would be unable to complete its responsibility for data governance in providing an off-site storage capability. If replacement efforts were unavailable then severe degrade capability in responding to a disaster could occur which would destroy the server infrastructure. In addition, this would require multiple days or weeks to regain functionality and or access to the data.

If replacement efforts were established for the entire complete infrastructure, the cost to the government would be phenomenal, not including the time and possible loss of information.

7. Describe the market research conducted (how it was made, websites, tests, calls, interviews made, etc.) and the results of the research.

A Request for Information (RFI) was submitted on GSA Ebuy website. There are at least 29

Government-Side Acquisition Contract (GWAC) holders, 17 of them are small businesses under the North American Industry Classification System (NAICS) code 423430, who may be capable of supporting the hardware requirement. The National Institute of Health Information Technology Acquisition and Assessment Center (NITAAC), was verified not to have Dell PPDM resources. There are many sources to choose from, both in small and large businesses. Due to small business competition being available, this may be awarded to a small business set-aside, as long as the potential Contractor meets all the requirements.

8.
