Nancy Schumm PRIME AE Group, Inc
Dear Mrs. Schumm:
This letter is in reference to our conversation concerning the upcoming drainage project located in Prince George’s County, Maryland to be performed on the behalf of Prince George’s County Department of the Environment. This project, as presented, is located at or near CSX Transportation (CSXT) railroad property and/or tracks owned or operated by CSXT in College Park, Maryland near milepost BAA 31.81.
After consideration of the documents you have provided illustrating the location of the proposed drainage work and our discussion of the scope of work, it is my opinion that the work will, as described, have little impact to CSXT’s property and/or CSXT’s ability to facilitate the movement of rail traffic at this location.
By this letter, CSXT acknowledges that Prince George’s County Department of the Environment or its representative may proceed with the proposed work without further involvement of or consent from CSXT. This acknowledgement is exclusive to the drainage work as described for this project and shall not mean or intend to communicate that CSXT will waive future involvement in drainage projects and/or not hold Prince George’s County Department of the Environment or its representative accountable for satisfying CSXT's Design and Construction (D&C) Standard Specifications for drainage occupancies that may impact CSXT in the future.
This consent does not release Prince George’s County Department of the Environment or its representative from the responsibility of any damages resulting from the impending drainage work to CSXT’s property or CSXT’S ability to facilitate the movement of rail traffic at this location.
Unauthorized occupancy on CSXT’s property will be subject to removal, relocation or modification of the installed facilities at the Outside Party’s sole expense without notification from CSXT.
Respectfully, Anthony L. Gilmore, MBA.
