About this file
This file is an Iranian Investment Disclosure certification form required pursuant to Section 103-g of the New York State General Municipal Law for the Community Development Consulting & Transition Services contract opportunity in Jefferson County, New York. By submitting a bid, each bidder must certify under penalty of perjury that it is not on the list of entities with investments in Iran created pursuant to Section 165-a of the New York State Finance Law. Bids submitted without compliance with this certification requirement shall not be considered for award. Bidders unable to make the required certification must submit a signed statement detailing the reasons for non-compliance.
The form provides two circumstances under which a bidder unable to certify may still be considered for award on a case-by-case basis: first, if the investment activities in Iran occurred before April 12, 2012, have not been expanded or renewed after that date, and the bidder has adopted and is implementing a formal written plan to cease such investments and refrain from new Iranian investments; or second, if the political subdivision determines in writing that the goods or services are necessary for it to perform its functions and that exempting the bidder is essential to obtaining the required services. This disclosure requirement is a mandatory compliance certification for all bidders on this New York State contract.
