About this file
This is an Iranian Investment Disclosure certification document required by New York State General Municipal Law Section 103-g for bidders responding to a Personal Emergency Response System (PERS) contract opportunity with the Jefferson County Office for the Aging in New York. By submitting a bid, each bidder must certify under penalty of perjury that it is not on the list created pursuant to New York State Finance Law Section 165-a, which identifies entities with investment activities in Iran. The certification requirement applies to all bidders, and failure to comply will render a bid ineligible for award consideration.
Bidders unable to provide the required certification must submit a detailed signed statement explaining the reasons for non-compliance. However, the purchasing unit may award a bid on a case-by-case basis if the bidder demonstrates that any Iranian investment activities occurred before April 12, 2012, have not been expanded or renewed since that date, and the bidder has adopted and is implementing a formal plan to cease such investments; alternatively, an exemption may be granted if the political subdivision determines in writing that the goods or services are necessary for it to perform its functions and that no other bidders can provide the required services.

2. The political subdivision makes a determination that the goods or services are necessary for the political subdivision to perform its functions and that, absent such an exemption, the political subdivision would be unable to obtain the goods and services for which the contract is offered. Such a determination shall be made in writing and shall be a public document.
