About this file
This is an Iranian Investment Disclosure certification document required for bidders submitting proposals to the State of New York for a Road and Maintenance Equipment Replacement Parts and Labor contract (Prior Bid #2024F-12). The document serves as an attachment certification pursuant to Section 103-g of the New York State General Municipal Law and requires all bidders to certify under penalty of perjury that they are not listed on the Iran divestment list created under New York State Finance Law Section 165-a. Bidders must complete the certification by providing their company name, title, signature, and date. Any bid submitted without compliance with this certification requirement will not be considered for award.
The document provides two exemption pathways should a bidder be unable to make the required certification. First, a bidder may proceed if all Iranian investment activities occurred before April 12, 2012, have not been expanded or renewed since that date, and the bidder has adopted and is implementing a formal written plan to cease such investments. Second, a political subdivision may grant an exemption on a case-by-case basis if it determines in writing that the goods or services are necessary for the performance of its functions and cannot be obtained otherwise. This disclosure is a mandatory compliance requirement for all prospective contractors responding to this New York State contract opportunity.

2. The political subdivision makes a determination that the goods or services are necessary for the political subdivision to perform its functions and that, absent such an exemption, the political subdivision would be unable to obtain the goods and services for which the contract is offered.
