About this file
This document is a Request for Proposal (RFP) issued by the InterMountain Education Service District (IMESD) in Pendleton, Oregon for a project to install ductless "mini-split" HVAC units throughout their facility. The project scope includes providing the specified equipment, sizes, and quantities detailed in the exhibits, as well as a decommissioning and removal plan for the existing roof-top units. The RFP has a mandatory pre-proposal meeting on September 28, 2022, with proposals due on October 27, 2022. The project is anticipated to be completed in two phases, with substantial completion by December 30, 2022 for phase 2 and January 31, 2023 for phase 3. The successful proposer will be expected to comply with federal and state regulations, as the project is expected to be partially funded by federal grants.
The RFP outlines specific proposal requirements, evaluation criteria focused on cost, references, the proposal itself, and serviceability. It also includes standard contract terms such as prevailing wage requirements, performance bond, insurance, and restrictions on mechanics liens. Pricing terms are not explicitly stated, but the RFP indicates the project may experience cost escalation for equipment purchased in 2023.

2 PROJECT INFORMATION
2.1 Project Description
The InterMountain ESD, 2001 SW Nye Ave., Pendleton, Oregon, is in the former Pendleton Community
Hospital, built in 1960. In 1989, the ESD bought and remodeled this building. For heating and cooling the facility, two large Carrier RTU units were installed. Nearly 25 years later, these units are being replaced with ductless “mini-splits” on the first floor of the building.
In the spring of 2022, eight mini-splits units were installed in the business department of the IMESD.
The plan is to continue to install these mini-splits throughout the building and abandon both RTUs. An additional part of the RFP is to determine the availability and cost to provide power to these units. Also, two mixing units will need to be installed to replace the air circulation provided by the present RTUs. A decommissioning and demolition/removal plan for the existing RTUs will need to be developed and included within the RFP.
The eight mini-splits installed in the spring of 2022, were a combination of Rudd and Daikin units, varying in size from 7K to 18K. In an effort to stay consistent, all future mini-splits will also be Rudd or
Daikin units.
We anticipate the project to be partially funded by Federal Grants. Therefore, the successful proposers will follow both federal and state regulations.
2.2 Project Scope of Work
Work includes providing equipment specified in Exhibit 1 in the sizes and quantities based on Exhibit 2.

Information that has not been properly marked and segregated may be disclosed in response to a public records request. When exempt information is mixed with nonexempt information, the non-exempt information must be disclosed. The IMESD will redact pages that include both exempt and nonexempt information to allow disclosure of the nonexempt information.
Unless expressly provided otherwise in this RFP or in a separate communication, the IMESD does not agree to withhold from public disclosure any information submitted in confidence by a Proposer unless the information is otherwise exempt under Oregon law. The IMESD considers Proposals submitted in response to this RFP to be submitted in confidence only until the IMESD’s evaluation is complete and the IMESD has acted on the Notice of Intent to Award.

Debarment and Suspension and Other Responsibility Matters Primary Covered Transactions
2 CFR 200.213- Non-federal entities are subject to the non-procurement debarment and suspension regulations implementing Executive Orders 12549 and 12689, 2 CFR part 180. These regulations restrict awards, subawards, and contracts with certain parties that are debarred, suspended, or otherwise excluded from or ineligible for participation in Federal assistance programs or activities.
(Before completing certification, read instructions on next page.)
(1) The prospective primary participant certifies to the best of its knowledge and belief that it and its principals:
(a) Are not presently debarred, suspended, proposed for disbarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency;
(b) Have not within a three-year period preceding this application been convicted of or had a civil judgment rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property;
(c) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1)(b) of this certification; and
(d) Have not within a three-year period preceding this application had one or more public transactions
(Federal, State, or local) terminated for cause or default.
(2) Where the prospective primary participant is unable to certify to any of the statements in this certification, such prospective primary participant shall attach an explanation to this proposal.

Instructions for Certification
1. By signing and submitting this form, the prospective lower tier participant is providing the certification set out on the reverse side in accordance with these instructions.
2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.
3. The prospective lower tier participant shall provide immediate written notice to the person to whom this proposal is submitted if at any time the prospective lower tier participant learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
4. The terms "covered transaction," "debarred," "suspended," "ineligible," "lower tier covered transaction," "participant," "person," "primary covered transaction," "principal," "proposal," and
"voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and
Coverage sections of rules implementing Executive Order 12549. You may contact the person to which this proposal is submitted for assistance in obtaining a copy of those regulations.
5. The prospective lower tier participant agrees by submitting this form that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.
6. The prospective lower tier participant further agrees by submitting this form that it will include this clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion
- Lower Tier Covered Transactions," without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transactions.
7. A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tier covered transaction that it is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows that the certification is erroneous. A participant may decide the method and frequency by which it determines the eligibility of its principals. Each participant may, but is not required to, check the Nonprocurement List.
8. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of a participant are not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
9. Except for transactions authorized under paragraph 5 of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.
