About this file

This is an Insurance Requirements document for a contract with the State of Michigan. The document establishes mandatory insurance coverage that contractors must maintain throughout the contract term and for specified periods following completion of work activities. Contractors are required to obtain Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 general aggregate, Automobile Liability Insurance with $1,000,000 per accident limits including hired and non-owned vehicle coverage, Workers' Compensation Insurance according to applicable state laws, and Employers Liability Insurance with $500,000 limits per accident and disease categories. All insurance policies must be provided by carriers with an A.M. Best rating of "A-" or better with financial size VII or better, must name the State of Michigan and its departments, divisions, agencies, offices, commissions, officers, employees, and agents as additional insureds, and must be primary and non-contributing to any comparable State insurance coverage.

For claims-made policies, contractors must establish retroactive dates prior to contract commencement and maintain coverage for a minimum of three years following contract completion, including extended reporting coverage if policies are cancelled or not renewed. Contractors are responsible for submitting insurance certificates to the Contract Administrator at contract formation and within twenty calendar days of policy expiration dates, ensuring subcontractors maintain equivalent coverage, notifying the Contract Administrator within five business days of any insurance cancellation, and waiving all rights against the State for damages covered by insurance. The requirements do not limit contractor liability for indemnification, defense, and hold harmless obligations under the contract.
