About this file
This is an Insurance Requirements document for the State of Michigan establishing mandatory coverage standards for contractors performing work under state agreements. The contractor must maintain comprehensive insurance protection at its own expense, with all policies required to be primary and non-contributing to state insurance. Coverage requirements include Commercial General Liability with minimum limits of $1,000,000 per occurrence and $2,000,000 general aggregate, Automobile Liability at $1,000,000 per accident with hired and non-owned vehicle coverage, Workers' Compensation according to applicable law, Employers Liability at $500,000 per accident, and Garagekeepers Liability at $1,000,000 per occurrence for applicable contractors. All insurance providers must maintain an A.M. Best rating of "A-" or better with financial size category VII or better. The State of Michigan and its departments must be named as additional insureds on all applicable policies using specified endorsement forms.
The contractor bears full responsibility for all losses or damages to state property and personal property under its care, custody, and control up to replacement value, with property insurance evidence required for any off-site contract locations. For claims-made policies, contractors must provide retroactive coverage dating before the contract effective date and maintain coverage for a minimum of three years post-completion, including extended reporting coverage if policies are cancelled. Contractors must submit certificates of insurance to the Contract Administrator at contract formation and within twenty days of policy expiration dates, notify the administrator within five business days of any policy cancellation, require equivalent insurance from all subcontractors, and waive all rights against the state for damages covered by insurance.
