About this file

This is an Insurance Requirements document outlining mandatory coverage requirements for bidders on a state contract. The bidder must procure and maintain insurance coverage for the duration of the contract to protect against claims for injuries to persons or property arising from performance of work. Required coverage includes commercial general liability on an occurrence basis with products and completed operations, workers' compensation and employer's liability as required by law, vehicle liability insurance on an occurrence basis, and environmental impairment liability insurance. The bidder must maintain minimum limits of $1,000,000 per occurrence for commercial general liability, workers' compensation as mandated by applicable law, $400,000 per occurrence for vehicle liability, and $1,000,000 for professional liability.

All insurance policies must be primary coverage, with any state-maintained insurance serving as excess coverage that does not contribute to the bidder's policies. Coverage must apply separately to each insured against whom a claim or suit is brought, subject to the insurer's liability limits. The bidder must furnish the state with certificates of insurance and required endorsements signed by an authorized insurer representative before contract commencement, with the state retaining the right to request complete certified copies of all policies. All policies must contain a revised cancellation clause providing 30 days' notice to the state in the event of cancellation for any reason, including nonpayment. The state may waive these requirements at its discretion.
