Proposals received after the date/time specified will not be evaluated. In accordance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals. 4. Basis of Award
A. Award will be made in accordance with FAR 13.1 – Simplified Acquisition Procedures and FAR 15.101 – Best Value Continuum, the procedures specified in the SOW and on the basis of the BEST VALUE proposal. An award may be awarded to the contractor who is deemed responsible IAW FAR 9.1, as supplemented, whose proposal conforms to the FOPR’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the FOPR instructions) and is judged, based on the evaluation factors and subfactors, to represent the BEST VALUE to the Government.
B. The Government will review offeror Price Schedules and arrange all proposals from lowest-priced to highest-priced. Price Schedules must be complete in order to be further considered. The Government will then evaluate offerors’ Price Schedules and rate as either acceptable or unacceptable for each of the subfactor. An acceptable subfactor clearly meets the minimum requirements of the solicitation. Unacceptable technical proposals may not be further evaluated; however, the Government may conduct interchanges, as determined by the CO. The Government will then evaluate offerors’ Price Schedules and rate as either Fair and Reasonable or Not Fair and Reasonable. Not Fair and Reasonable proposals may not be further evaluated; however, the Government may conduct interchanges as determined by the CO. Fair and Reasonableness will be determined by comparison to the Independent Government Estimate, other prices proposed, historical prices paid, or any other price analysis technique identified in FAR 15.404-1(b)(2). Price comparison using one or more of these techniques may identify unreasonable pricing (too low or too high). Proposals with prices deemed unreasonable may be considered non awardable, as they may not provide the best value to the government or may indicate a lack of understanding of the requirements or costs associated with the contract.
C. The Government intends to make award based on the initial proposal submissions without conducting interchanges. Therefore, each offer should contain an offeror’s best terms. However, the Government reserves the right to hold interchanges through use of the Interchange Notices (INs) if, during the evaluation, it is determined to be in the best interest of the Government. INs are fluid interaction(s) between the CO and the contractors that may address any aspect of the proposal and may or may not be documented in real time. Offeror responses to INs will be considered in making the order selection decision. Interchanges may be conducted with one, some or all offerors as the Government is not required to conduct interchanges with any or all contractors responding to this statement of work.
