About this file
This document is a Letter of Interest (LOI) from the U.S. General Services Administration (GSA) Region 7 regarding a planned Utility Energy Service Contract (UESC) project. The project will implement various energy conservation measures (ECMs) at multiple government-owned facilities in Texas and Louisiana, funded in part by the Inflation Reduction Act (IRA) of 2022.
The LOI outlines the specific ECMs to be implemented at each facility, including measures such as installing electric boilers, EV charging stations, high-performance HVAC systems, microgrid/battery energy storage, and renewable energy upgrades. The goals for the project are to achieve sustainable, all-electric, and net-zero buildings. GSA is interested in awarding the UESC project utilizing their existing Authorization for Energy Management Services (EMSA) contract vehicle. The LOI provides details on the required Preliminary Assessment and Investment Grade Audit processes, as well as specific formatting and reporting requirements. Interested utilities are requested to respond by May 17, 2024, indicating their interest and qualifications to provide the UESC services.

In Reference: Letter of Interest (LOI) Eastern Area Inflation Reduction Act (IRA of 2022) Utility Energy Service Contract (UESC)
Note: The Inflation Reduction Act of 2022 (IRA), Pub. L. No. 117-169, enacted in August 2022, provided GSA with significant funding for (a) measures necessary to convert facilities to high-performance green buildings, (b) acquisition and installation of construction materials and products with substantially lower levels of embodied greenhouse gas emissions, and (c) emerging and sustainable technologies. The Contract resulting from this Synopsis will be funded in part by IRA appropriations, and it contains numerous IRA-specific requirements. Requirements include, but are not limited to, requirements regarding pricing, invoicing, submittals, materials, and construction. In addition, please note that the Solicitation will contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Once received, offerors shall carefully review the Solicitation, the Agreement, the Statement of Work, the Specifications, and the Drawings. Offerors are responsible for accurately pricing and, if successful, fully performing all Contract requirements.

We are interested in awarding viable IRA projects utilizing the Authorization for Energy Management Services (EMSA), pursuant to the terms, conditions and exhibits of your GSA Area-Wide Utility Contract (AWC).
This letter is only a request for information regarding your company’s energy management services offerings, willingness, experience and qualifications to provide a customized UESC program for the listed locations and does not constitute authorization to proceed with any work.
GSA will require the following regarding Preliminary Assessments (PAs) and Investment Grade Audits (IGAs):
1. Preliminary Assessment (PA) to be performed at no cost to the Government
2. The utility must conduct a financier competition.
3. If the utility is going to subcontract to an Energy Service Company (ESCO) partner, the opportunity must be competed and the ESCO selected on the basis of Best Value.
4. Use of DOE’s eProject Builder (ePB) is required for TO schedules. Schedules should be provided for the PA, and at the 50% and 90% completion points of the IGA, or as otherwise determined necessary by the Contracting Officer.
5. The PA and IGA must follow the format and requirements outlined in Section H.4, H.5, and H.6 of the DOE ESPC/IDIQ requirements (See Attachment: Reference DOE IDIQ - Section H.4 - for PA Report Requirements, Section H.5 - IGA Report Requirements, and H.6 - Financing Competition Requirements).
5a. Exceptions - H.5.B ECM Performance Measurement shall be replaced with the requirements detailed in Performance Assurance Planning, Continuous Design-Level Performance of Each Energy Conservation Measure in a Utility Energy Service Contract is Fundamental to Achieving Projected Results, dated February 2019 (See Attachment).
5b. Exceptions - H.6 for Financing Competition Requirements: Investment Deal Summary (IDS), also known as Finance Proposal Summary format, shall be based upon Attachment 3, included with this LOI, and not DOE attachment J-11.
6. Hazardous Materials: If asbestos, lead paint, Polychlorinated biphenyls (PCBs), or other toxic or hazardous materials or substances are encountered, the utility/ESCO must have the ability to remove or remediate such material or substances, if required by GSA. During the IGA phase of the project, the Contractor is required to perform a pre-alteration hazardous material assessment of all areas that may be disturbed during the implementation of ECMs.
If your company is prepared to offer such services as identified in the exhibit and commonly referred to as UESC, we would like to hear from your organization. Please send an email to patrick.chapman@gsa.gov, to indicate your interest. If interested, he will follow up with you to discuss the matter further. If selected, the next step will be a meeting to set the groundwork for a potential partnership.
If we do not hear from you by May 17, 2024; 3:00 p.m. CST; we will consider it a response that your company is not interested in pursuing a UESC with GSA at this time.
If you have any questions or concerns, please contact Mr. Patrick L. Chapman Sr. at patrick.chapman@gsa.gov.
Regards, Patrick L. Chapman Sr.
