About this file

This document is an industry day presentation for the Survivable Airborne Operations Center (SAOC) Beddown at Offutt Air Force Base, Nebraska, conducted by USACE Omaha District. The presentation outlines a military construction program to support the replacement of the aging E-4B Nightwatch aircraft with the newer E-4C SAOC platform, with Sierra Nevada Corporation awarded a $13.08 billion contract in April 2024. The Air Force approved Offutt AFB as the preferred beddown location on May 6, 2024, pending NEPA completion estimated for September 2026.

The SAOC beddown project comprises five major facilities under a Design-Bid-Build acquisition model: (1) a 2-Bay Maintenance Hangar with Ramps and Taxiway (280,000 SF facility plus 56 acres of paving, $500M+ magnitude, target FY28 award, 42-month duration) with an Ignitable Liquid Drainage Floor Assembly and 254-foot clear span doors; (2) a 1-Bay Fuel Cell Hangar (129,000 SF, $250M-$500M, target FY30 award, 36 months); (3) Operations and Training Facility (133,000 SF, $250M-$500M, target FY28 award, 36 months); (4) Fire Station (15,000 SF, $25M-$100M, target FY29 award, 36 months); and (5) Supply Storage Facility (160,000 SF, $100M-$250M, target FY29 award, 30 months). The acquisition is structured as an unrestricted, firm fixed-price contract using a best-value trade-off bifurcated selection process. NAICS code 236220 applies with a $45 million small business size standard. Key considerations include Project Labor Agreement requirements (pending market research outcomes and litigation resolution), CMMC Level I self-assessment requirements, bonding, and site environmental remediation including PFAS and lead contamination. Ramps and Taxiway utilizes government design while the 2-Bay Hangar uses non-government architect-engineer design. Design contracts are being executed through USACE MATOCs with the 35% Relative-to-Award hangar design posted for award in December 2025 (target award May 2026). Questions may be submitted via ProjNet through Jessica Jackson (jessica.r.jackson@usace.army.mil) or Margarette Wolfe (margarette.e.wolfe@usace.army.mil).

• Magnitude of Construction for consolidated effort >$500M

• Unrestricted

• Subject to outcome of Market Research

– Bonding

– PLAs

– CMMC

– Sources Sought/PLA Survey ~Feb-Mar 2026 timeframe

ACQUISITION OVERVIEW

• BLUF: PLA will be included unless the results of Market Research indicate inclusion will limit competition. PLAs are not an evaluation factor but (if included) is a condition of award.

BACKGROUND: Beginning in 2009, PLAs were considered optional for construction projects over $25 million dollars in value under a prior Executive Order (EO) 13502.

• On February 4, 2022, President Biden signed EO 14063, entitled “Use of Project Labor Agreements for Federal Construction.” Under EO 14063, the President required PLAs for all construction projects over $35 million dollars in value, subject to exceptions and terms in EO 14063. EO 14063 also directed the FAR Council to promulgate FAR provisions codifying EO 14063 in the FAR, resulting in FAR Subpart 22.5. See FAR 22.501.

• Extensive litigation followed until the decision in MVL USA, Inc. v. United States, 174 Fed. Cl. 437, 463 (2025), which found that a PLA requirement may or may not be acceptable, depending on the circumstances in an individual solicitation.

• On February 7, 2025, the Undersecretary of Defense issued a memorandum that introduced a Class Deviation waiving the PLA requirement. That memorandum was successfully challenged and enjoined in the case of North America’s Building Trades Unions (NABTU) v. Department of Defense et al., No. 1:25-cv-01070 (DDC May 16, 2025).

• The Class Deviation was rescinded on June 2, 2025. Thereafter, DoD agencies were required to follow the FAR Subpart 22.5 requirements.

• December 18, 2025, the U.S. Court of Federal Claims ruled in Brasfield & Gorrie, LLC v. United States, COFC Case No. 25-1140, that a requirement to use a PLA on a large-scale federal construction project (contract value over $35 million) violates the Competition in Contracting Act (CICA). The court further issued a permanent injunction removing the PLA requirement from the challenged solicitation.

• USACE Districts are awaiting implementation guidance from DOJ and HQUSACE, in light of the Brasfield decision. It is possible that an appeal could be filed with the Court of Appeals for the Federal Circuit.

PLA

• Level I – Self-Assessment

• Effective 10 Nov 2025 CMMC is required for all non-COTS acquisitions >$10k

• DFARS Clause 252.204-7021 will apply

• Prior to award, the Contracting Officer must verify in SPRS the awardee holds a current CMMC that meets or exceeds the level required for the action.

• IAW DFARS 252.204-7021, the definition of current for a Level I Self-Assessment is, “not older than 1 year with no changes in compliance with the requirements at 32 CFR part 170 since the Conditional CMMC Status date and a corresponding affirmation of continuous compliance, not older than 1 year, by an affirming official

• Further, IAW DFARS 204.7501(b), Contracting officers shall not exercise an option period or extend the period of performance on a contract, task order, or delivery order, unless the contract has a current (i.e., not more than 3 years old) CMMC certificate at the level required by the contract, task order, or delivery order.

QUESTIONS FOR INDUSTRY

General

• What risks do you see with the current approach?

• How do we make it easier/more appealing to the market?

• What are we not thinking about?

• PLA

• CMMC

• Bonding

• Addressing PFAS

• What is your estimated cost for the 2-Bay with Ramps? Magnitude of Construction is >$500M

Estimated construction durations too aggressive, or not aggressive enough?

• 2-Bay with Ramps and Taxiway – 42 months

• O&TF – 36 months

• Supply Storage – 24 months

• 1-Bay – 30 months
