About this file

This document is Amendment 0001 to Solicitation 75H71026Q00220, issued by Kayenta Health Center Acquisition Department in Kayenta, Arizona, effective August 17, 2026.

The solicitation is an Indian-Owned Small Business Economic Enterprise (ISBEE) set-aside for hazmat supplies and personal protective equipment. The amendment revises three contract line items (CLINs) and extends the closing date. CLIN 4 is revised to specify "MAS-R-C21-Kit-L, MIRA Safety C21-Full-Face Respirator Tact Gas Mask Large/Right, Quantity: 6." CLIN 17 is revised to reflect "4–5 packs of sealing tape OR 20 individual rolls" for Kappler ChemTape Biological Hazard Sealing Tape. Section E of the solicitation is revised from requiring NIOSH-certified equipment to NIOSH-approved equipment. The solicitation closing date and time is extended from August 10, 2026 at 12:00 PM (MDT) to August 21, 2026 at 4:00 PM (MDT).

The full solicitation requires 18 CLINs of CBRN defense and decontamination equipment, including gas masks (MIRA Safety models), filters, protective gloves, decontamination wipes and powders, and replacement kits. Offerors must submit three volumes: technical capability and demonstrated experience with manufacturer specifications demonstrating NIOSH approval; a delivery schedule with maximum 30-day After Receipt of Order (ARO) requirement and preferred 8–15 day ARO delivery; and a standalone firm-fixed-price quote on company letterhead. Evaluation factors are technical capability, price, and delivery schedule, with delivery capability receiving significant weight. The solicitation is set aside exclusively for Indian Economic Enterprises as defined under the Buy Indian Act, requiring offerors to meet 51 percent Indian ownership and provide certification of eligibility at time of offer, award, and throughout contract performance.

NAIHS-ACQ-09 UNAUTHORIZED COMMITMENTS NOV 2025

(a) Definitions.

Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.

Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.

Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.

(b) Policy.

The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority. Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a Federal official other than the contracting officer (see FAR 1.403-2). Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.

(c) Procedure.

Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.

The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid. The Contractor https://www.cdc.gov/coronavirus/2019-ncov/hcp/respirators-strategy/index.html https://www.cdc.gov/niosh/npptl/respirators/testing/NonNIOSHresults.html https://www.cdc.gov/niosh/npptl/respirators/testing/ExpiredN95results.html https://www.fda.gov/media/138740/download proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

SECTION E – SOLICITATION PROVISIONS

52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL

PRODUCTS AND COMMERCIAL SERVICES

Quoters/Offerors that include in their submission any information they consider proprietary or confidential shall mark the cover page of their submission with the following legend and identify within their submission which specific sections or pages contain such information:

"This submission contains proprietary and/or confidential commercial or financial information that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed for any purpose other than to evaluate this submission."

General Submission Guidelines: Offerors must submit their proposals electronically in the required volumes. Do not include any pricing information in Volume I.

Volume I: Technical Capability & Demonstrated Experience Provide a detailed narrative describing the proposed solution and the vendor's capability to fulfill the requirement.

The submission must include:

• Product Compliance: Manufacturer specification sheets demonstrating that the proposed hazmat masks and CBRN filters are NIOSH approved and meet OSHA fit-testing requirements by accommodating varying staff facial profiles.

• Demonstrated Experience: Evidence of the firm's technical capability and corporate experience successfully sourcing and delivering similar specialized personal protective equipment (PPE) or CBRN respiratory protection equipment to healthcare, federal, or emergency response facilities.

Volume II: Delivery Schedule Submit a proposed delivery schedule identifying the anticipated delivery timeline in Days After Receipt of Order (ARO). The schedule shall demonstrate the vendor's logistical approach to meeting the Government's requirement and resolving the respirator shortage.

Delivery requirements are as follows:

• Delivery must not exceed 30 days ARO. Proposals exceeding 30 days ARO may be determined technically unacceptable and ineligible for award.

• Vendors proposing guaranteed delivery within 8–15 days ARO will receive a significant evaluation advantage under the Government's tradeoff analysis.

Volume III: Standalone Commercial Quote Submit a formal, standalone quote on company letterhead detailing the total Firm-Fixed-Price (FFP) for all items required by the solicitation. The quote should identify unit prices, extended prices, and the total proposed price.

Note: Do not merely submit a completed SF-1449. The Government intends to attach the successful offeror's standalone quote directly to the final award document.

Failure to follow these instructions and/or provide all required information may render the proposal unacceptable.

Submit all documents in PDF format.

52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES

NOV 2025

(DEVIATION)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1: Technical Capability & Demonstrated Experience

The government will evaluate the vendor’s overall capability to successfully fulfill the requirement. To be evaluated favorably, the vendor must demonstrate relevant experience supplying the exact items listed on the provided item specifications sheet, ensuring that all supplied equipment is NIOSH-approved and has been successfully delivered to healthcare, federal, or emergency response facilities.

Factor 2: Price

The Government will evaluate the total proposed price for fairness and reasonableness.

Factor 3: Delivery Schedule

As the third most important evaluation factor, the Government will assess the vendor’s proposed timeline and logistical approach to resolving KHC’s respirator shortage. Vendors must state a firm delivery schedule in Days After Receipt of Order (ARO), evaluated as follows:

• Mandatory Minimum: Delivery must be no later than 30 days ARO. Any proposal exceeding 30 days ARO will be deemed technically unacceptable and excluded from award.

• Tradeoff Advantage: Proposals offering guaranteed delivery within 8 to 15 days ARO will receive a substantial evaluation advantage.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
