About this file

This is a self-certification form for Indian Economic Enterprise (IEE) representation used by the Indian Health Service (IHS) under the Buy Indian Act authority.

The form establishes eligibility requirements for offerors responding to IHS solicitations, sources sought notices, or requests for information. Enterprises must meet the definition of "Indian Economic Enterprise" with Indian ownership (51% minimum) as defined in HHSAR 326.601 at three critical junctures: when the offer is submitted, at the time of contract award, and throughout the full contract performance period. Any change in eligibility status during these periods requires immediate written notification to the Contracting Officer. The form requires offerors to self-certify their eligibility status by indicating whether they do or do not meet the IEE definition and must include the name of the federally recognized tribal entity, the 51% owner, business name, UEI number, certifying signature, and printed name. Successful offerors must also maintain registration with the System of Award Management (SAM). The form warns that false or misleading information submitted in offers constitutes a violation under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Individual Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts under the Buy Indian Act, and awards are subject to protest if offeror eligibility is questioned.
