About this file
This is a self-certification representation form for the Buy Indian Act Indian Economic Enterprise (IEE) program administered by the Indian Health Service (IHS), Department of Health & Human Services.
The form is used in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations to certify that an offeror meets the definition of an "Indian Economic Enterprise" as defined in HHSAR 326.601. Offerors must demonstrate compliance with IEE eligibility requirements at three critical points: when submitting an offer, at the time of contract award, and throughout the full contract performance period. Any loss of eligibility status during these periods requires immediate written notification to the Contracting Officer. The form requires documentation including the name of the Federally Recognized Tribal Entity, business name, DUNS number, the name of the 51% owner of the IEE firm, and a certifying signature with printed name. Contracting Officers may request supporting documentation of eligibility before awarding set-aside or sole source contracts, and awards may be subject to protest. Successful offerors must also maintain registration with the System of Award Management (SAM). False or misleading information submitted during the offer process constitutes a violation under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
