About this file
The document is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise (IEE) Representation Form designed for businesses seeking to qualify for tribal set-aside contracts. The form requires self-certification that the offeror meets the definition of an "Indian Economic Enterprise" with at least 51% Indian ownership, a requirement that must be maintained from offer submission through contract performance. The form emphasizes legal consequences for false representation, including potential violations under 18 U.S.C. 1001 and 31 U.S.C. 3729-3731, and mandates that contractors immediately notify the Contracting Officer if they no longer meet eligibility requirements.
Businesses must complete the form by indicating whether they meet the IEE definition, provide details about tribal ownership, and be registered in the System of Award Management (SAM). Individual Contracting Officers retain the right to request additional documentation to verify eligibility before awarding set-aside or sole source contracts under the Buy Indian Act. The form is a critical component for Indian-owned businesses seeking federal contract opportunities with the Indian Health Service, ensuring compliance with the Buy Indian Act's provisions for supporting tribal economic enterprises.
