About this file

This is an Indian Economic Enterprise Representation Form issued by the Indian Health Service (IHS), Department of Health & Human Services, for use with federal contract solicitations under the Buy Indian Act.

The form serves as a self-certification document for offerors responding to Sources Sought Notices, Requests for Information (RFI), or formal solicitations related to DFM Equipment (Solicitation IHS-SS-26-1525093, dated 08-21-2026). Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian Ownership as defined under 25 U.S.C. 47 and HHSAR 326.601. Certification is required at three critical junctures: at the time of offer submission, at contract award, and throughout the entire contract performance period. Offerors must immediately notify the Contracting Officer in writing if they cease to meet eligibility requirements at any point. Successful offerors must also maintain registration with the System of Award Management (SAM). The form requires the offeror to provide the name of the federally recognized tribal entity, the 51% owner of the Indian Economic Enterprise firm, business name, and SAM UEI number. False or misleading information submitted with an offer is punishable under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if offeror eligibility is questioned.
